By the way, does anyone know how long these RFE letters take to reach in the mail? I'm moving to a new apartment by Friday (7/12/2019) and I'm wondering if the letter will arrive in time before I move (crossing fingers).

That's a long wait. I've seen some on here say they got their s within a matter of 5 days or less. I'm hoping this is true in my case, 30-45 days is excessively long for USPS to deliver local mail to me.

Hi, my priority date for F2a child under 21 is  july/24/20117 and its been like almost 24 months and they still hasn't approved it yet , i checked on USCIS website they requested for evidence RFE on july/3/2019 and i haven't received the letter in the mail so i was wondering the same how much time will take for the letter to arrive in the mail, i hope it arrives soon, please would not mind to tell us what the RFE is once you receive the letter and when?

Sure, I'll update you on what my RFE is requesting (and when received) and I guess you can do the same. I'm very perplexed what more evidence they are requesting because I was extremely thorough in sending every category of evidence to establish a bona fide marriage with my spouse. I hope it is something simple like we missed answering a question on the form or something easy (crossing fingers).

You should receive it today or tomorrow.

The letters arrive in 5-7 business days. Mine was sent on a Thursday and arrived the next Monday. If you don't get it by Friday, just talk to your front office manager.

Hello, Im new here. Im overseas, my wife is a LPR and applied for i130. My PD is Jan 18 2019. I know I have a long wait ahead, just wanted to know from you guys if it is a 2 year wait? Also, all priority dates are now current. But (correct if Im wrong) there is nothing I could do ahead before getting the i130 approval, isn it?

Hi, hope your doing well, hey i got the RFE letter in mail , it says that its recommended that the petitioner and the beneficiary  do a DNA test to see  the relationship that they claim to be , so in this case its my father and his children under 21, the problem is i am little confused , they also asked that we should also submit secondary evidence like , medical records, church records, school records, insurance records, employment records, financial record, residence record,census or tribal records, government records which are passport and identification documents, family photos,  and some of them i don;'t even have them , isn't DNA test enough for them to prove that they are really connected. and third i live in Dubai on resident visa but my other 3 siblings live on a tourist visa so suppose if my father who is in US goes to a AABB certified facility to do DNA test , will they sent the DNA kit to US embassy in Dubai for us to do the test  or should we go back to our home country , i mean like will they do it here because my siblings live on a tourist visa ..

Well, that's wonderful you finally got your RFE (I'm still awaiting mines). Although that only seem to be the start of more complications for you, as you say, a DNA is 100 percent proof of a bona fide parental relationship. It's just puzzling that they would ask for a DNA in addition to other supporting evidence. The secondary supporting evidence, I would imagine, should only be used if you are unable to do a DNA test, not in addition to one. That's just unfair. 

 

I terms of how you should execute and respond to your RFE, I truly am in the dark on how best you should proceed. Honestly, if I were in your shoes, I would pay for a very good US immigration lawyer to help me respond to the RFE. The reason why I say this is because they seem to be having serious doubts on the claimed relationship and getting an RFE is already a strike again us in getting an approval, you don't want to mess this part up by inadvertently sending insufficient supporting documents (as counterproductive as that may seem relative to a DNA test).

 

Honestly, I suspect because of your country of petition (Middle East), they are placing exceedingly higher and (seemingly) unfair burden of proof on you (and probably others from this part of the world). (The politics of it is well established). In summary, I would highly recommend that you see a reputable immigration attorney because of the complex nature of your RFE.

"...there is nothing I could do ahead before getting the i130 approval, isn it?" You are correct! You're just going to have to sit tight and hang in there for approximately 19-20 months. Well, lately, they "seem" to be processing F2A petitions a lot faster of late, so perhaps if they continue this trend, it could be anywhere from 3-5 months below the above estimated time frame. The current "c" status is for those who are applicable to file AOS or already have approved petitions waiting for NVC/Counselor processing.

Thank you so much for all the great advice and suggestion, i will definitely consider all the things you mentioned above, yes your completely right i should proceed very carefully, because one mistake more and it will lead to more delays and who know what more it could create some serious issue . yes the better option is to acquire a good immigration lawyer so he could take good care of all the process... i wish you all the best.. hope your receive good news soon..  i am also little confused you mentioned why would they ask for the secondary evidence anyway.. lets see what happens next......
