I thought I am the only one. We are in the exact same situation. My priority date is 12/28/2018 F2A with california visa center. I also applied for an EAD work authorization as well as AOS my priority date is 09/11/2018. Both priority dates are current based on the processing times in the visa bulletin. However, I haven't heard anything yet. I had an apointment with USCIS in august of 2018 to make sure that my marriage was not a fraud probably...bunch of questions but haven't heard any acceptance or RFE yet. I also need desperately to work. I call them almost every week and they put new inquiries...they say I will hear back from them within 30 days... But I never do. So disapointing. I also tried to take an apointment INFOPASS in my local USCIS office here in chicago... They said they don't take anymore. I was wondering if I can go to an indiana USCIS even if I am from chicago ? Thanks guys

Going to Indiana might not yield much result since another office is handling your case but if you have time on your hands you can try that.

Since last year USCIS is phasing out the self scheduled INFOPASS appointments and converting to an entirely online service. For an appointment to be scheduled you would need to call the customer support number and speak with a tier 2 officer who's gonna schedule one for you if he/she deems it appropriate. Right now there are still some field offices that take walk in requests and appointments. The new system will roll out everywhere by the end of this fiscal year - September 2019.

Hello ALL,

I am a LPR who filed for my spouse in Nigeria.
The priority date is   January 16, 2019
When should I be expecting the I130 to be approved?
The field office is California service centre

At the moment they are just treating May 2017. Normally F2A takes 22 to 24 months to get approved, so probably u can be looking at getting approved December 2020

It takes almost two years for approval, and over two years total for the whole process to end and your spouse to join you.

If it takes 2 years to approve I130. How long will it then take to get the whole process done with? I have heard it takes less than 2 years for Nigerians in f2a category.

After approval for F2A category it may take 10 to 12 months before interview process. Therefore the whole process may take between 32 to 36 months to conclude the process except if the petitioner get naturalized and the case is upgraded then the process will speed up thereby reducing the waiting time

To be honest I’m not 100% sure whether you have to wait until your RFE gets resolved , but I would assume that you shouldn’t ? What if you had filled for AOS a few months ago and received RFE just now , your I-485 would be still in pending , right? In the worst case scanerio they just won’t accept your AOS package along with the check , so no loss , it’s not a denial , just rejection to accept . So you’ll resend after the RFE is resolved . But I am afraid misguide you , may be order a consultation with a lawyer?

All the forms you’ve listed are correct , I’ve attached a checklist that I was using while applying for AOS (got it from my lawyer). Let me know if you can see it . You can ignore the evidence documents since you just sent it , but I think all the rest would be useful to attach if you can.

P.S. Work permit and advance parole approval took exactly 3 months in my case .

AOS DETAILED CHECKLIST (AOS).pdf

One question I have is, you have 8 photos listed. I ordered 6 because I thought 6 were enough. Is there anything I am missing?

I think the list my lawyer sent me was generic for the case when I-130 and I-485 are filled together , that’s why 2 extra photos . In your case 6 is enough , 2 per each application (except medical form and affidavit of support ). Also , I’d suggest you to write on the back of each photo (by pencil!) your full name . USCIS is known for loosing photos :D

Thank you so much. You have been so helpful. Should I write a letter for the EAD/AP? Because I had to write one for my OPT EAD.

You are welcome! Nope, you shouldn’t write a letter , you don’t have to explain anything , the c9 category EAD is a different kind of benefit than OPT .

**don't forget to attach copy of your OPT EAD to that I-765 application

Should we fill out the i864A? We do not have any children. I am the intending immigrant. I have mentioned my income in i864.
