Mine worked because they sent an RFE and on uscis.gov it doesnt show. But on this other website it does show the date that they sent the RFE.

I have an account with this website as well. it shows the same thing i have no idea how the process these cases. I saw people got approval for may 28, while people are waiting with PD April.

@Reynizzle Sorry for the delay in the response.

You have to check the second chart in the Visa bulletin.It shows filing date and for your category(i believe it is F2A) it shows a date.

You can do AOS ,only if you are in the USA with a valid status.

I130 not approved yet!!! I submitted the online e-request couple times and received the same reply below: 

 

Thank you for your inquiry. We recognize your interest in the final adjudication of your pending application/petition and are aware of the difficulties caused by any delay in processing. We regret we are not able to give you a timeframe for when we will review your case but the California Service Center is committed to processing this workload. We will be making every effort to adjudicate your case in the most efficient manner based on our available resources. We appreciate your patience and understanding.

 

Please advise...

Did you call them? because they are processing May 2017 you should get approval on October 2018.

Yes and they said your case is outside normal processing time so we will send e-request for you and i got the same response that I attached earlier. I told them that i know people who got approval with priority dates after dec, 2016 and they said you cant relay on that cause each case is treated in a different way and it also depends on the country too...but i was't convinced!!

wow, so you tried everything i think the best way is to just make an appointment with local office and let them know .

I just replied to the RFE that I received. Is it a good idea to submit my AOS regardless or should I wait to hear back about the RFE? My PD is April 10, 2017. I’m already late for my AOS

Do you mean adjustment of status? I don't know how long the wait it at your local office, so I'd suggest you check that before applying. You might add another year to your wait. Can't you go through consular processing? By the time you receive an approval and your case is at NVC, your PD could be current. We are talking about 3-4 months at most.

Well, I don’t think it’s 3-4 months , I would say closer to 6 months mark, but in case If he mentioned in his I-130 form that he is willing to go through AOS process, then his case will never be transferred to NVC, therefore , additional I-824 form has to be filled (application for action on an approved application ) , which itself takes   8 months to be approved

It's not clear what's you're referring to as time frames. I think he can receive an approval in 2-4 weeks assuming he provided everything they ask for. After that he has to wait 2.5 months for a case number. It would take 3-4 months, I don't know how you came up with 6 😶 And considering the current VB + steady advancement in the next 3 months = his PD current in July ( 4 months from now roughly). It's a pretty much done deal, even if the VB slows down.

As to AOS, he needs to file i-485 and the processing time varies depending on the local office. But I'm hearing its rarely under a year. So it's gonna add quite some time, and hence my advice to go through consular processing instead.

 

P.S. You don't mention in i-130 whether you are going through AOS or not. You got that all confused. You file i-485 and that stops the petition from proceeding to NVC.
