Thank you for all the Info,

It’s really discouraging finding out that even as a immediate relative things are still moving slow. I will talk to my husband about the possibility of filling now i485, even though it’s pretty expensive but we have to find a way.

Yes, it is discouraging.

You can see if filing later is an option, there are some expenses indeed. The medical is recommended to submit with the I-485, I am not sure of the cost, depends on the provider. If you have evidence of vaccinations, better, and in some cases your health insurance can cover the costs.

If I end up filling I 485 now, I can also file for EAD and i131 right?  Any idea how much the medical examination could cost?

Yes, you can file for both of them, both are free to file with your AOS package, it is recommended to include a little letter explaining that you filed them with your I-485. Sometimes people are asked to pay or submit evidence they qualify for an exception (as an NOA1 for I-485 for example). That could help with avoiding the delay.

and also, for the affidavit of support, what’s the minimum my husband (in this case) has to make per year? I’m just asking to see if we would need a co-sponsor as well.

Depends on the size of your household. I don't know how have you and your husband filed for your tax returns in the aspect of household size, but for a household of 2 people, the minimum income is $25,725 per year. For that evidence you have to show previous tax returns, and evidence of income this year, (such as pay stubs of a few months), that way they can calculate how much would it be this year's income as well. You can check additional info on that here: https://www.uscis.gov/i-864p

@Tenreyro thank you again for answering me. I  do have one more question. What reasons are to be accepted for i131? Do you need a valid one or just in case of emergency would be fine? I don’t know how to approach this.

I really though that as a immediate relative things will move a lot faster. This whole process is just exhausting, especially because I can’t legally work. :(:(

Just talking about the speed of processing, have you ever considered consular processing which takes much less time? When your husband becomes USC, you can upgrade your case and your visa number is immediately available. By then you might have your interview scheduled within one or two months, and get your visa within a few weeks since the interview. I know you are in the states but you also could opt for consular processing  like those who are overseas. The only problem is if your schedule is flexible enough to arrange the trip to home country for the interview.

So I didn’t know this could be possible. Could you detail more about the process or put a link here where I could read all about it?

Also,  we would both need to go to my home country for the interview?

would I be able to come back right away if I go for my interview?

would I need to have i131 approved by then so I can return or I would need to stay in my home country for the rest of the time until it gets approved?

One always can do consular processing but for those are already physically in the US there is one more option which is AOS. On the USCIS web it says “Adjustment of status is the process that you can use to apply for lawful permanent resident status (also known as applying for a Green Card) when you are present in the United States.

But If you are outside of the United States, you must obtain your visa abroad through consular processing.”

Link: https://www.uscis.gov/greencard/adjustment-of-status

Here is another link from ***removed*** explains the pros and cons for both processes.

My PD is 29 December 2017 and service center is California and am still waiting. But I want to ask that if the petitioner is a green card holder and he files i130  for the beneficiary . But the petitioner has applied for his citizenship. If the beneficiary gets it i130 approved before the petitioner gets his citizenship. Then the beneficiary will have to wait for the F2A category to be current before moving to NVC and I learnt the current waiting time is two years.

Is this true??

yup thats true

Our PD is 20-Apr-2017 for F2A India with Consular Processing. I live in New York State but as luck would have it ours went to California, which has the longest queue.

I am eligible for applying early for my citizenship next week. We are expecting our child end of this year. The process for bringing a child over is pretty convoluted, since the child of a US Citizen is no longer a derivative and would need separate I-130 filed.  Calculating the time required for I-130 approval for the child, it feels more logical to hold off on the citizenship and wait it out in this F2A process.  My attorney was guiding along the same lines.

Good to see a few days movement in the Final Action dates for F2A India in the July bulletin.
