Evidence for entire marriage period

Good evening,

We're sending our i-751 package in two weeks. USCIS guidelines say to send evidence covering the entire period of the marriage.

We got married in 2013 and had our I-130 interview in Dec 2014. Visa received in Jan 2015 and POE was Feb 2015.

As part of our I-130, we already had to provide the legitimacy of our marriage, which essentially covered 2013 and 2014.

Do we need to re-send all the information from 2013, or 2015 and 2016 is good enough?

The instructions are clear: you need to send evidence from the beginning of your marriage. Go ahead and re-send it. I know it's a pain - but do it. It takes so long to get the I-751 - you don't want an RFE to slow down the process!

Thanks for the response.

I have been browsing the threads here and it seems like most people send just evidence from the last two years.

We both lived abroad during the i130 and when moved, we closed all the bank accounts. The only things we have left is a copy of our lease for 2013 and 2014, vacations and that I have been an authorized CC user since 2013.

We have a very extensive list of evidences from the moment we moved, and my concern is that if I add the items from before living here, it will somehow confuse USCIS.

I sent everything from the last two years. It's all we have. We lived separately during our CR-1 application and were turned away when trying to create joint accounts while I was in the UK. If that's a reason to be deported then whatever lol.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I sent evidence from the date of entry to ROC (2 yrs). Including 2 yrs tax returns and financial evidence every other month for the last 24 no.

CR1 / CR2 Visa:

(Day 1) 12/16/11: I-130 Application sent

(Day 283) 09/24/12: Interview at US Consulate – Approved!

(Day 287) 09/28/12: Visa Received & Immediately entered US using Visa

(Day 290) 10/01/12: Social Security Card sent automatically

Removal of Conditions CR1 / CR2
(Day 1) 07/28/14: Application sent.
(Day 135) 12/10/14: ROC Approved!
(Day 143) 12/18/14: 10 year GC received (IR1 / IR2)

Naturalization:
(Day 1) 06/30/15: Application sent.
(Day 210) 01/26/16: Interview and Oath Ceremony. DONE!

***Son and I became US Citizens 01/26/16***

(Day 1) 01/27/16: Applied for my U.S. Passport
(Day 14) 02/10/16: Passport Book & Cert of Naturalization received

(Day 1) 03/16/16: Applied for U.S. Passport for son

(Day 22) 04/07/16: Passport book and original docs received...(Card rec'd 04/16/16)

N-600 for child age 9
(Day 1) 01/27/16: Application sent

(Day 12) 02/08/16: NOA received

(Day 23) 02/19/16: Case received at local office

(Day 88) 04/23/16: In line for oath scheduling *Called USCIS to inquire about why there is an oath required for a child under 14. They sent a service request to the field office.

(Day 95) 04/30/16: Received letter from field office to say no oath necessary and that they would mail the certificate.
(Day 106) 05/11/16: Cert of Citizenship received by registered mail (they never sent tracking. case status was never updated either)

So it seems that we shouldn't get any issues if we only provide co-mingling evidences from Feb 2015.

I checked our I-130 package and the only useful evidences are:

  • lease agreement showing both names
  • vacations
  • Authorized user on a credit card (from 2013)

We already sent it all to USCIS, so I'm not entirely sure what's the purpose and whether we actually need to show it again.

Any thoughts and comments are more that welcome!

I never implied they will. This is our interpretation of this process:

  • They approved I-130 based on the evidences that cover 7 months of marriage.
  • They do not know what happened to us from that time point until November this year.
  • They want new evidences to show the marriage is still legit.

It's probably too good to be true, although based on the threads in this forum it looks like majority of the people send evidences covering the last two years.

Actually you are implying that. You're implying you don't need to send evidence you already sent with the I-130. However, if that evidence is financial in nature, or something like a power of attorney or wills, I would recommend sending it again. Never try to interpret what the USCIS "may" be asking for. Always take them literally. If you have evidence that is before immigrating that would help a ROC case, submit it again. If all you have is some communication like emails or visits to see each other, then that may not be useful. It still doesn't hurt to send it.

Most people only send the last 2 years, but many also get an RFE for more evidence. Some send very little and don't though. Personally, I think being over prepared for something like this, helps.

K-1 applicants who are now removing conditions will have evidence going back to marriage since they came here to be married and moved in with their spouse-to-be right away.

CR-1 applicants are likely to have barely anything because they lived separately during the process. If they could create joint accounts while apart, then great! If not, then that's life.

Send in what you have, you can't magic up evidence that isn't there. If it's not good enough for them then they will send an RFE and/or interview you.

We decided to include our apartment lease (both names on contract) and wire transfers from abroad to my wife's account in the US.

EDIT: Also will include authorized users from 2013.
