Hello everyone. I was petitioned under EB2 and my interview will be on nov 16.

In my contract it states that my annual salary of 96500, and the facility where I will be working will be determined once I arrive in the US.

however, my friend with the same category as I do told me that they were asked about the hourly rate and the specific facility where I will be assigned and when they failed to answer those questions then they were put to 221g status.

my question is. How would I know my hourly rate if the annual salary is the only one indicated in the contract?

What will I answer to the consul about specific facility on where I will be assign if the contract says "it will be determined only once I arrive in the US"?

Note: I am under a staffing agency and the consul won't accept an answer like "it will be determined only once I arrive in the US".. They want an specific answer for the facility's name according to my friend and if I can't provide that. They will put me on 221g.

I asked my employer about specific facility and they just told me to answer it as "it will be determined only once I arrive in the US". What should I do? :(

Hourly rate calculations

Salary: $96,500.00

Weekly rate: $96,500/52 weeks = $1,855.77 per week

Hourly rate:$1,855.77/40 hrs = $46.39 per hour

The hourly rate is based on the assumption that you will be working the standard 40 hours per week.

Try and get a employment offer from the employer. They may list the location in your letter. If not, present the official offer letter and go from there.

I agree with Greenbaum, get an official offer letter from your employer. Keep in mind that the the average US salary is around $50,000 per year, so your quoted salary is quite high considering you don't know any further details. Make sure you have supporting documents so that you don't raise any red flags.

I have the employment letter and contract already. it just indicated that I will be hired by the agency. thats all. no hospital was specified. this agency is NY registered. is that fine?

I know the average is 50k a year and the average for staff nurse is 63k a year. well as you can see it. I am a nurse supervisor and that offer is not high considering my position is supervisory and not just an entry level nurse.

FYI this is the ladder.

staff nurse then charge nurse then head nurse and THEN nurse supervisor. It is a 3 step higher than staff nurse which has an average of 63k a year. do the math :)

No one can say for sure if the documents you have will be enough for you to pass the interview. As we see it we can only comment on what we know. Sometimes that's not all encompassing. At this point it sounds like you have everything that you can get from your agency so you'll just have to trust that it will be enough.

The agency must have experience with this. They have a vested interest in your success.

Goid luck. You've worked hard to get to this point and new doors are opening for you. Bright future is ahead of you.

I have seen a handful of successful EB2 visa for nurses in the last few years. It's kinda surprising your visa got this far in the process due to the over abundance now of nurses in the USA.
