I-134 and Child Support Payments

Timeline

On Form I-134, Affidavit of Support, do I need to comprehend child support payments I am responsible for? In particular, I have children who are not in my custody, so they are not claimed as dependents on my tax returns. But since I am responsible for ongoing child support, do I claim on this form that they are dependent on me for support?

You don't have to include the child support payment in I-134.



However, you need to include your children in your household size when calculating 125% poverty level requirement.



You count all minor children regardless of whether they are claimed as dependents on your tax returns or not.

Thank you Merrytooth. But on the I-134 the only place I see to add them to my household size is on question 8 that is "The following persons are dependent upon me for support:". And an indication of "Wholly Dependent" or "Partially Dependent". Is that where I list them? And indicate partially dependent?

I can't find any official USCIS document for the 'wholly or partially dependent' issue.

The general consensus is :

. If you do not have custody and the child do not live with you then the child is partially dependent on you for support.

. If the child lives with you and you do not receive any money from you Ex, the the child is "wholly" dependent on you.

Since you are paying child support, I will put down 'partially dependent'.
