I have been looking at the instructions and checklist for form I-864, and would like to check if I am understanding it correctly.

I have been living out of the US and married for over 2 years (on a marriage visa i renew yearly). My parents will be our joint-spongers (US citizens-not by birth) with whom I am a dependent still on taxes, where my permanent address is in the US, and where my husband and I plan to live temporarily when we arrive in the US.

This is how much I have understood should be needed in our case (correct me if I am wrong or missing something please)

I-864 (petitioner-me)

-All pages filled, stapled, and pg 7 signed in front of notary (would be foreign notary in our case so + translation of notary??)

-Letter stating why I have not filed taxes (because I am a dependent of my parents who are JS, have no job, and am residing outside of the US)

-Evidence of domicile in US (or intent to est) (i.e. my foreign visa, permanent mailing address in US, doctor appointments during visit in US, etc)

I-864 (JP-Dad)

-All pages filled, stapled, and pg 7 signed in front of notary

-Federal tax transcripts/returns for past 3 years (does he need to attach a W2 because my mother is on taxes and going to be Household Member?)

-Evidence of current employment

-Evidence of US citizenship

I-864A (HM-Mom)

-All pages filled, stapled *** Part 2 & 5 completed by sponsor and notarized (is this sponsor me or my JP Dad?) *** Part 3, 4, &6 completed by HM and notarized

-Federal tax transcripts/returns for past 3 years (does she need to attach a W2 as well?)

-Evidence of current employment

-Evidence of US citizenship

Thank you guys ahead of time

Also what is my houshold size if it is my husband and I (we will be moving to an apartment but we put my parents address because we dont know where the apartment will be), with my parents (2) and younge brother?

W2's not needed when using transcripts and Joint Sponsor is combining income with Household Member. Nothing needs to be signed in front of notary.

For purposes of semantics, it's "JS" for Joint Sponsor, not "JP" as there is no such thing.

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Would you be so kind to tell me if you know: since my dad by himself exceeds the 125% above poverty line for the joint sponser, does my mom need to even fill a I864A (she does joint taxes with my father)?

These are the instructions for the I-864: https://www.uscis.gov/system/files_force/files/form/i-864instr.pdf

Nowhere does it say the form has to be signed in front of a notary. Furthermore, there is no place on the form where notary would sign and stamp their seal.

It's not necessary for your mom to complete an I-864A; however, your dad would need to submit his W2's with the transcript since they show only his income which is what is being used.

It's not necessary for your mom to complete an I-864A; however, your dad would need to submit his W2's with the transcript since they show only his income which is what is being used.

Correct regarding Notary, however, it is always best practice for joint filing couples to submit an I-864 from joint sponsor and I-864a from the joint filing spouse. This is not specifically required by any instructions, but is often asked for by the Consular Officer, delaying visa issue.

Just a note. If you're reading the wrong instructions for the I-864, make sure you download and use the most current form. The notary block went away years ago. Now you simply sign under penalty of perjury.
