Send a letter to USCIS with the case number and all your information and tell them you want to withdraw the petition.

I believe you'll get a confirmation from them they got your letter for the withdrawl. At that point you would be free to refile.

So if you sent it in now, by time you two see eachother again you should be more than able to simply resubmit the petition with new evidence of meeting.

Withdraw the petition now as you were advised and the prepare to visit again and by the time you will re file, if you have not received

any confirmation that the petition was administratively closed, you can still file and attach another request to withdraw the previous petition

and include your first letter of withdrawal request. You definitely do not have to wait to re file.

What was the reason of not having met within 2 years? If you can prove financial hardship or another acceptable reason (there were a few listed in the rfe they should be in yours as I don't remember them all) then you can still be approved... i know people that have done this and gotten approved with the right evidence. But it depends on your situation and reasons.

In my time here, I have seen two. In one case, the petitioner was totally disabled and unable to travel, bedridden, and his fiancee had tried multiple times to get a b2 so they could meet. The other involved a tiny religious sect, that forbade the two people meeting before marriage, even IF chaperoned.

OP, withdraw your present petition, make another trip, gather your evidence and refile. You cannot be approved as it stands.

I would not advise telling uscis you over expired your 2 years meeting and couldn't file your petition due to financial hardship, If that were the case. uscis would see it like this, if you have financial issues and could not afford to file your petition then how could you afford to support your foreign spouse? Not a good suggestion.

That's true but I didn't say if she can't afford the petition she could prove it to uscis because that's stupid, I said if she wasn't able to squeeze another visit within 2 years due to work/financial issues she could give evidence and they could waive the requirement. I was just stating that it was one of the allowed reasons on the RFE list for not meeting within 2 years. I never advised anything else. What the OP does is her choice and only she knows what's best for her situation. I was just giving another perspective.

not allowed reasons for not meeting within 2 years. It is NOT an option, even with a boat load of evidence.

Uhm I received an RFE to send more evidence of meeting and those WERE allowed reasons listed for not meeting the requirement in which you could receive a waiver but regardless I was JUST SAYING. I never told OP to do it because I don't know their reasons for not having met in over 2 years. SO you can stop attacking me for putting my 2 cents in ?

Goodness! I haven't seen my husband in 5 months and I'm really struggling. I can't imagine not seeing him in over 2 years. I would take a second job to pay for a ticket to see him, sell my TV, borrow from my family, I'd crawl all the way there to see him if there wasn't an ocean between us. Apart from the bedridden situation and the religion that doesn't permit unmarried persons to meet, I can't see why anyone would not be able to meet in 2 years. Or that anyone would just accept that situation. I understand some countries struggle to get a B2 but Americans can travel to most countries fairly easily in terms of entry requirements.
