RFE- requirement that petitioner and beneficiary have met in person

Hi, i need help in the RFE for my k1 visa application for my fiance. They are asking for the evidence of meeting the beneficiary. We met last January to February 2014. I filed the petition August 2016. Is the time that we met(Jan-Feb 2014) still valid for the 2 years meeting prior to petition? Thank you.

Did you submit a declaration of how you met? Did you include supporting evidence such as boarding passes, passport stamps, pictures, hotel bills in both names, etc to prove that you were together? I got an RFE to provide more supporting evidence of having met as well and these are the things I included in my RFE. I initially included itineraries and pictures and other things but I think the declaration of how you met is very important to them.

Yes, I did include all of those except the hotel bills because he would just pick me up and we go out somewhere. What I'm worried about is that we met 2 years and 7 months before I filed the petition. I want to know if that is still acceptable within the 2 years requirement preceding the filing of the petition? Was this the last time you saw them? If you last saw them in February 2014 then you should have filed by February 2016. As you filed in August 2016 you filed more than two years after you last saw them.

Looks like you waited too long to file. Can't be more than 2years between meeting and filing, even if you spent a month together. If it's been more than 2 years since your last face to face, you're gonna have to make another visit and refile, I don't think you can just add a new trip to your current case, it will probably be denied.

No it is not. Your visit was more than 2 years ago.

The paralegal was wrong, if it has been more than two years since you last met you can not file until after you meet again.

I'm not really sure a paralegal should be doling out that kind advice, especially since it seems to be incorrect.

Please do not take any more advice from a paralegal. You have to start over and file again after you made another trip.

You can also marry while you are there and file for a CR1.....just a thought.

yeah that's what im gonna do. do u know how long it will take to cancel the application? and how to withdraw it. thanks!
