You can petition her , you would have to prove that she is unlikely to become a pulbic charge at the time of the interview but that is decades down the road. Many downs affected people are highly functional. IF your parents are aging what is your plan for the period before her priority date becomes current.

This will not be over quickly. You will not enjoy this.

Hello,

I have a sister with down syndrome living in India. I am living in USA. My green card application is in progress. I would like to know if there is any option for me to get my sister her to stay with me. She is extremely sweet responsible person. Only problem with her is that she is not much into learning/education. Has anyone been successful in getting their sibling to USA?

Thank you so much for your help and thoughts.

hi

not possible for now, you have to be a USC to file for siblings and it takes over 12 years to get a GC

so in all the wait will be over 15 years,

it doesn't matter to immigration that your sister has down

if she would have been studious, she could have tried for a student visa. I had a friend whose granddaughter had down and graduated from college.

So she could have come to study for a few years, but then she would have had to return to India, she can't stay illegally in the country

Unfortunately, the wait will be very long for you and her. First you have to become a US citizen. Only citizens can apply for siblings. That will be about 3 - 5 years. Then you can apply for her but it will take more than 10 years for her to wait for a visa.

As mentioned above, you can petition her and her down syndrome is not a reason to deny her visa, but it will take around 14 years (more if you are not a citizen yet as you'd need to wait for that until you can start the petition). There is no way to expedite this waiting period, so if your parents do not think they can take care of her for this long, you may need to look into residential treatment, or you moving back to India for a few years.

There is a chance that over and above the normal I-864, you will be asked to show you can support her financially, in terms of her medical needs, and if her DS means she cannot work.

Investor visa? So she has the $500,000 requirement to show she is an investor?

Now you are fishing for visas, and it will only lead to more harm (through disappointment) than good.

A student visa was mentioned so you can investigate that option. But it requires an acceptance in school and for her to show she has the full years tuition in her account. It is unfortunate but her options are limited. If she is really in need of care you still have the option to move to her in her country.

Thank you for your reply. I was not exactly thinking about investor visa for her. I thought it is not even possible as she is not skilled and hence she cannot invest money in any business even if she has money. I was thinking if it is possible for my parents to invest money and get residence for her as well? Yes. Definitely I will go back to her if it is not an option. I am trying out this option so badly only because US is a great country for a person with special needs. She is often subjected to teasing or mocking in the place where she resides and she literally stopped going outside for that reason. She is always preferring to stay home.

If she is a minor, then if your parents invest enough money and get an investors visa for themselves, she can come as a dependent. Unfortunately, that does not work once she is legally an adult, even if they have guardianship of her.

There is one option that is somewhat quicker- you can petition for one or both of your parents to get immigration visas, it takes about a year. Once they are here, they can petition for her which takes about 7 years, cutting down the overall wait time almost in half. However, it would mean one of your parents would need to reside in the USA for all that time to maintain their greencard, which may be difficult.

Personally I think some of the time lines mentioned are highly optimistic.

When it comes down to it you either need lots of time or lots of money.

Or you need to be the one that moves.
