We are waiting, although not for that reason, I have my SSN but I need to file back home first to have the final number on my foreign earned income for the exclusion.

we sent all of his tax information between 2013-2015. (transcripts) They ask for the followings:

  • all supporting tax documentation (which we already sent for 2015, that's why we wonder if we should send 2016..)
  • evidence assets OR submit a joint sponsor (ownerships, bank statement of 12 months)

That's why I don't get why they want supporting tax documentation of the recent tax year. We have no idea why they say he doesn't make enough for the poverty line, the only thing comes to our mind is that the didn't make much money in 2013, since he studied back then. We checked and it is more than 125%.. So now we decided to obtain a joint sponsor, and send in his papers, but we are just not 100% sure if we should send his tax information for 2016 or the other papers they ask for.

There has been many rfe's saying similar things.. which is why I'm asking exactly what are they stating the reason is? For anything that was missing, it will automatically say that you don't meet 125% EVEN IF YOU DO. It just means that there wasn't enough evidence that you met it for your household size. Meaning one of 3 things

1. He actually doesn't meet it

2. There wasn't enough evidence

3. The household portion is not filled in correctly

To know which it is I'll need to know what you mean by "all tax information", which exact documents, to help and also like I said exactly what it says in the rfe :)

Yes, but what other tax supporting documents "exist' for 2015.. That's what I don't know.. IT says: Submit all supporting tax documentation (W-2s, 1099s, Form 2555,- he doesn't have these since he is self-employed, and has no foreign income either) and all supporting tax schedules -what is a tax schedule anyway? :S ) submitted to the IRS for the most recent tax year.

Schedules C and C-EZ

Schedules C and C-EZ are forms that you use to report self-employment income. Essentially, both forms separately report your business earnings and deductions to arrive at your net business profit or loss, which is then added to your other income on Form 1040. If you have a single business with simple accounting that meets IRS qualifications, you can use the shorter Schedule C-EZ, rather than Schedule C.

It could be this they are missing. Also for self-employed it's advised to send bank-slips and statements to support the income claim. Did you do that?

 

Edit: but I thought this was included (the schedule) in the transcript.. It is harder to prove income when self-employed for sure..

It's about showing as much as possible to show consistent enough income... the bank-slips would be sort of instead of pay-stubs and a bank-statement (even for last 12 months if possible) would support this.

But it does explicitly say "supporting schedules" and I have seen that they have requested w2's from ppl who sent transcripts as well, when this also shouldn't really be needed. It is harder to prove income when self-employed for sure.. 

 

If you go through all of these things and still feel you need a co-sponsor, fair enough..BUT even if you have a co-sponsor they will want the main sponsor's tax info, so I'm not sure that would solve the problem..

Thanks a lot for your help, I really appreciate it! Well, we will send the schedule C, and bank statements too, we might still go with the co-sponsor though as well just to be 100% safe..
