Yeah, if you send the tax return you need to have all the forms and attachments including the W-2s. Or you can go the easy route and get a free tax transcript from the IRS!! Even the online home-printed version will do, and with a transcript you don't need to send any of the attachments.

About the assets, you can also use the immigrant's ones, even a savings account back in the home country counts - but you need to attach and translate documentation.

If they say it's not meeting the 125%, you definitely need assets or a joint sponsor.

Edit: I saw Suss&Camm's post and she's right, if the income is really above 125%, you just need to send the transcript and documentation. Don't forget to include a new SIGNED form I-864 with the submission, ok? ;)

The 2nd point doesn't mean she doesn't make enough. It just mean you failed to prove that she does... to correct that all you need is to send what's required in point one. Once you have proved her income point 2 becomes mute.

It's generated automatically since the burden of proof is on you.

Yes sure send both transcript and w2... even though not required it can't hurt either :)

If you use the search tool and read some other rfe threads you'll see the same thing. Maybe you'll feel more "secure" if you have verification of this from more places. I know it's a nervous position to be in. :) but no, no co-sponsor is needed.

That's the transcript!! Make sure it's a tax return transcript for the 2015 tax year. There are other kinds of transcript. They made a mistake if they refused the correct one at the first time around.

Yes, treat the RFE I-864 as if starting from scratch, that's a good idea.

One quick question about the Biometrics. Does an successful early walk-in speed things up or is it just to get it done and they proced with your case after the given Bio appointment date anyways?

Just wondering if I - when I get the letter - should go there immediately or if I just wait until my appointment is up.

One quick question about the Biometrics. Does an successful early walk-in speed things up or is it just to get it done and they proced with your case after the given Bio appointment date anyways?

I don't think anyone actually knows this for a fact, but stories on here point to that it makes no difference. As I mentioned I had a medical reason, but I think many as you say just want to have it done, and maybe hope that it might make it go faster. It won't make it go slower at least so to each their own :)

I can not believe that it's been a WHOLE YEAR since we were document hunting for the i-129F petition. In December of last year my now husband had just left from a 3 month visit with me and I was heartbroken not knowing when I'd see him again. Now we are married and will have our first xmas together! It's a bit "pinch-myself-unreal" :luv:

Quick question which has been on my mind, When sending the package because the 1040s for both my wife and her mother (joint sponsor) were e-file. They didn't bother to sign the downloaded copies, is it possible to get an RFE for the non-signed 1040s even though all supporting documents such as W2s and job letters are present?

It's not legal without the signature. Order transcripts form the IRS for both wife and mother. That will solve a lot of potential problems.

Not sure but if it says e-file then the signatures probably not needed. If you have the tax transcript I would send in those. Otherwise, send in what you have. The fees go up 12.23.16.

I already filed AOS package, did Bio metrics this past monday(19th December). Also i already requested and have in my possession IRS transcript but it's killing me if i get RFE for signature on the 1040 :(.

We filed with printed turbotax 1040ez and copies of w2's, same as with the i-134. When filing TurboTax it says "no signature is needed when filing online..."

My reasoning was actually that if this is signed after the fact it's not a copy of the return, since the original return was never signed. Since there was no problem with the evidence for i-134 I also assumed this was a correct reasoning. I have never seen anyone on VisaJourney get an RFE for this signature not being there. What I have seen is RFE's for the accompanying w2's.

My guess is we will both be fine, but I guess we will find out :) If an RFE were indeed to be given for this it will be a quick and easy fix so don't stress about it. Let's just update our fellow VJ'ers on how it turns out :)
