I sent in employer letters, 6 months worth of payslips, and her tax return. She never got me her w-2s so the first point is asking for the supporting tax documentation (w-2s, 1099s, form 2555, and all supporting tax schedules)

The second point says based on the documents submitted, the sponsor did not meet 125%. It says to submit evidence of assets that meet the standards or obtain a joint sponsor. Then it just gives a list of suitable assets and info about joint sponsors.

So I don't think giving in the additional tax info will help with the second point, though I'll get it anyway. She doesn't own assets so it may have to be the joint sponsor, which isn't a problem, just more paperwork :lol:

Yep! That's your whole problem right there.... a 1040 has to be accompanied by the w2... (or you can send the irs tax transcript instead of those two)

The second point is only a standard point generated since the W2 wasn't submitted... it only means you didn't provide the necessary proof that she makes the stated income...

From what you're telling me it's only the w2's missing.. seen tons of those RFE's on here :)

Easy fix and no co-sponsor necessary :D

The 2nd point doesn't mean she doesn't make enough. It just mean you failed to prove that she does... to correct that all you need is to send what's required in point one. Once you have proved her income point 2 becomes mute.

It's generated automatically since the burden of proof is on you.

Yes sure send both transcript and w2... even though not required it can't hurt either :)

If you use the search tool and read some other rfe threads you'll see the same thing. Maybe you'll feel more "secure" if you have verification of this from more places. I know it's a nervous position to be in. :) but no, no co-sponsor is needed.

Guyss i'm excited!! Uscis case status for ead changed to new card is being produced ? Hope everything goes smoothly for everyone!

Yeah, if you send the tax return you need to have all the forms and attachments including the W-2s. Or you can go the easy route and get a free tax transcript from the IRS!! Even the online home-printed version will do, and with a transcript you don't need to send any of the attachments.

About the assets, you can also use the immigrant's ones, even a savings account back in the home country counts - but you need to attach and translate documentation.

If they say it's not meeting the 125%, you definitely need assets or a joint sponsor.

Edit: I saw Suss&Camm's post and she's right, if the income is really above 125%, you just need to send the transcript and documentation. Don't forget to include a new SIGNED form I-864 with the submission, ok? ;)

Now, seriously, getting this kind of thing makes me feel not so much stuck on limbo anymore, it's refreshing.

December is ending and that EAD is approaching...

Things are finally starting to take a turn for the best. Had clinical depression the last couple months due to the whole change in my life. Finally getting out of it. VJ support was invaluable :)

Bank of America. I bank with them, both my joint and separate checkings and savings are there.

Since I was already a customer, they had all my documents. My husband added me to his Target credit card soon after we got married and I think that helped build some credit history. Then BofA gave me an offer to apply, I did and got approved. I do have excellent money management skills, though, it may have helped.

Same here...it's so mental. I was jumping in front of the mailbox when I saw the NOA1 hardcopy. Especially cause I never got an email or text and I was close to 30 days. So today still no letter for Bio in the mail. Lets see tmw :)

BTW: I just realized that this forum is more for K1 people. I won the GC through the DV Lottery. I hope its still ok to post and read here. It just helps so much sharing the waiting time and the thousand thoughts I have about the process.
