I got an update today for a RFE. No biometrics mail yet. Sucks that theres an RFE but this is also a good sign that means they have touched my case.

K1 Visa

02/11/16....I-129F mailed to Lewisville, TX

02/17/16....Delivered at Lewisville, TX

02/19/16....Notice date

02/22/16....NOA1 E-mail. Case sent to CSC

03/02/16....NOA1 Hard copy recieved

04/28/16....NOA2 Approved (Notification received from USCIS App)

Hi November VJ fillers.

I done my biometrics in the morning 9 am today.
Everything was ok. Now I am waiting for next stage.
Who knows how long now I will have to wait for work permit and can I apply for SSN and driver's license before my EAD will be approved?
And what about Medical exam (I-763)? ( I did not sent this form with AOS package)
Do I have to wait and expect get RFE from USCIS or should I proceed for I-763 myself (seek Civil Surgeon in my area who will complete this form?)

If you have more than 14 days left on your i-94 you can apply for SSN at your local SSA office.... some of them are unfamiliar with this, so it might or might not go smoothly ;)

All state DMV's verify your immigration status against the same system as the SSA (SAVE system) which again means you need to have a valid immigration document. I believe what varies in the different states is what document is accepted. Someone correct me if I'm wrong here.

Medical is i-693 and if you do not have a valid K1 medical then yea... you'll need to get it done. I believe I've seen some ppl get RFE for it while others have been requested to bring it to their interview, possibly depending on if interview might be waived or not.

I got my RFE in the mail today, says my sponsor doesn't earn 125% of the poverty guideline. She earns $28,000 a year so I'm not sure how to fix that. What did you guys send in for proof of income? I have a joint sponsor if need be but I'd rather not use them if I can get away with it. She earned under the limit for the last 3 years but this year she took up an extra job so not sure if that impacted it, it shouldn't but who knows with USCIS :rolleyes:

I sent letter from employer stating annual salary, position is permanent, and "employed since" date, plus the 3 most recent pay stubs and the last year's tax transcript.

Last year's (but not the current) income was slightly below threshold, so I added a few assets and sent documentation for that as well.

As a good side note: I'm happy to see they're starting to adjudicate our cases already! YAY FOR US!!! We march filers deserve some speed, at last.

Yes it did. They should submit a job letter clearly stating her current income for now and when it started. If not they will go by what is on the recent tax return. Did you send 3 months worth of paystubs, an employer letter 1040 with w2s or tax transcript for current year 2015? That's what I sent in September and have not gotten an rfe even though my income was slightly below.

I sent in employer letters, 6 months worth of payslips, and her tax return. She never got me her w-2s so the first point is asking for the supporting tax documentation (w-2s, 1099s, form 2555, and all supporting tax schedules)

The second point says based on the documents submitted, the sponsor did not meet 125%. It says to submit evidence of assets that meet the standards or obtain a joint sponsor. Then it just gives a list of suitable assets and info about joint sponsors.

So I don't think giving in the additional tax info will help with the second point, though I'll get it anyway. She doesn't own assets so it may have to be the joint sponsor, which isn't a problem, just more paperwork :lol:

Yeah we sent in job letter with start dates, income and making it known the employment is permanent. 6 months of pay slips for each job. I think our mistake was not sending in the w-2s with the tax return.
