Hi all,

Hope you all enjoyed Thanksgiving! We married on November 3rd and send our paperwork November 14th. Not panicking yet but am a little concerned that I have not received any form of NOA1 (will check later to see if check has been cashed). Also, my K1 expires 12/08...if I haven't got NOA1 by then does this make me "out of status" and what Implications does that cause? and one more question: I forgot I had to to change my name on SS card, I will do it later this week...is that a major issue since they probably haven't started to process it yet anyway?

Thanks in advance!

Charlotte

Our package was received on November 17 still have not received NOA1 nor have they cashed our check.

No it does not make you out of status it's not a requirement to file AOS before the expiration of your K-1 visa my husbands expired October 9 we didn't file until November any overstay will be forgiven. It's only required to be married by that date.

If it were over 180 days of overstay before filing and the person applies for and uses an advance parole they will however be denied re-entry..

That's why I said that since she filed it will have no consequences, but waiting too long CAN have.

For immigration purposes yes, the overstay is forgiven.

Welcome Rock :)

Yes, the NOA1 for our I-129F was June 27. Our NOA2 was 57 days later, on August 23.

That may have been a little faster the many of the March filers, but a friend filed a month later, and was approved in 44 days.

We went really fast since receiving the visa.

On a good note, we got the I-485 NOA1 in the mail yesterday so that makes 3/3 hard copied received. We took them over to the local community college and enrolled my wife.... wow, I almost said fiance since I'm so used to posting that, in school so she can take classes. I got some good news from them on residency requirements. Right now she does not qualify for resident college fees but if I file taxes for 2016 and show them proof of the state return then her status could be changed to resident and she gets much lower class fees.

If filing jointly? Or doesn't matter? Great news though :)

FYI, the service request I put in for them to correct my name was processed the same day (yesterday) and right away showed status "Name Was Updated" on MyUSCIS for all cases. In case anyone has the same issue, know it was quickly fixed :)

Just some questions:

1) Why some people receibe their NOA1 first than others sending packages to same USCIS Office..

2) My i-94 expired Nov 22. I sent my package Nov 19. It was delivered November 21. Am I out of status now? Can I have problem if something happen ex. driving.

3) Can I travel internally via air without EAD approved yet. Ex. I want to go to Las Vegas from Massachusetts on January. Any risk?
