Today in the mail I got two I-797 Notices of Action - approvals.

One for EAD+AP stating it's a combo card and explaining about both benefits - which surprised me, usually the explanations weren't that good.

Another one for AP only.

 

This gives me some relief as I now know that they got my address change properly for EAD and AP too even though they'd only confirmed in writing the change for the I-485.

 

The wait for the combo card continues...

I received the same today! Congrats! Almost at the finish line! For now.... lol

So just to be clear , his 2017 year income is what is stated on the employment letter? (Wage x hours x weeks). Because I already wrote that part on the response to the first RFE and they didn't seem to accept it

What does your letter say?

The one we sent, mentioned hourly pay, type of employment, how many hours he works per week and year-to-date earnings. You didn't have all the pieces last time. They won't tell you if the letter was accepted or not. They might have been perfectly satisfied with the letter. It's the totality of the evidence to back the annual income claim that needs to be good. If you have two parts of the puzzle but not the third and final, you'll still get the same response as if you had no pieces. Since you said you were updating the i-864 then it's 2017 that this year's evidence should prove, so letter should be for 2017.

Which shouldn't matter, cause ou've got the pay stubs... The essential stuff is there..

In prep for our interview next week we are dancing around the income issues as well.

Just filed my 2016 taxes and although line 18 'Total Income' is $21,400 and over, line 22 ended up being $18,900.....

Our immigration lawyer says thats not good. Line 22 is what they will check.

 

We expect my 2017 income to be higher (over the 125%) and have year-to-date pay stubs to start building that case, however we were advised by our lawyer to bring a 'Back up' affidavit of support to the interview.  Just got the paperwork cleared with my mother who will joint sponsor us.   We expect to get questioned and try to work through my current income and sponsorship in the interview but the backup plan is to keep only use the affidavit if it seems that the immigration agent won't accept my current income.

 

Wonder if anyone else tried this?

So what did you use the first time around? Was your 2015 income enough as well? 

I am sure that if your lawyer thinks it's a good idea then it will not pose a problem. 

Also, do they look at the gross income on year to date paystubs or the income after taxes ?

I hate to say it... but this forum is a living testament to how much immigration lawyers get wrong. But hey, at least it's erring on the right side. :)

Wait I'm confused...

Firstly I apparently mixed up the "line numbers" when I was talking to ppl earlier.... Yes they look at anticipated total Income and that in fact is Line 22  (not the line I was saying earlier, sorry if I confused others! ).... It is not the AGI is the main point....  but I don't get what you mean by Total Income being Line 18? Or do I just need to go to sleep? Am I missing smth? :huh:
