My husband was a student all the way until April of 2016 when he started his new job. 

2015 tax returns weren't enough but we filed in 2015 with pay stubs for the past 8 months and letter from employer. 

Rfe in January about wrong household size. I fixed the issue. 

Now another RFE saying his income isn't high enough (when in fact it is by several thousands ). So 2015 return didn't not have enough but 2016 definitely does. I don't know what to do. 

Well for the 2016 return is says 25,789 adjusted gross income. So it's definitely enough. But not for 2015. His annual income is 26,767 which is what it says on his employment letter and what I wrote down on the annual income field. 

His annual income  isn't what they are looking for. His adjusted gross income is what they want. Based on his gross income that you stated his adjusted gross income would fall below the requirement. I would suggest getting a joint sponsor.

On a more serious note, if I could get the card until Thursday I'd be able to take care of the SSA and DMV this week. But that's only dreaming... as far as I know it could take them another whole week to mail the card.

Im not sure if anyone has had success sending in the following years tax returns. You filed in 2015 tax year and I'm not sure if sending 2016 tax returns would help. If you have a qualified joint sponsor id say go with that to avoid another RFE or possible denial that would delay you any further.

I've called USCIS twice. They said 2016 is fine but I'm not sure 

 so I will have a joint sponsor by the end of the week. They are retired though? Is that okay?

Do they have proof of income such as Social Security or a Pension? Assets?

Yes pension from a railroad company and tax returns. No assets I don't think. But I know the income is over 50k

A letter stating his pension and his tax returns for 2013 2014 2015 would be enough. Once your able to prove income and the adjusted gross is at the amount to support them and you then that should be fine.

If you could get tax transcripts from the joint sponsor that would be ideal but not required.

Will do! Thanks so much!!! I believe we have everything required besides a copy of a birth certificate but that can easily be obtained. Again, thank you so so much! We also have bank staments.

Is it costly to move to another state?? like if you're moving furniture and car etc...? what are some things I would need to consider/get done? Sometimes you have to go where the jobs are.  

 

Good luck friend!  I just finished

my first day and it was great.  I'm really lucky to have stumbled on that opportunity.  I even got to come home for lunch which was a nice surprise for my husband :-)

That's not correct. The current annual income that you enter is supposed to be the anticipated gross income for the year if you are a regular employee that receives a w2. If the sponsor is self-employed it is the anticipated AGI. If you file 1040EZ normally, it is again the anticipated AGI.

On the past year's returns (19a-c), you enter exactly what is on line 22 if regular 1040 and received not self-employed, AGI if self-employed and AGI if it was a 1040EZ.

 

Now, If past income hasn't changed until the current, i.e. no raises or job changes or similar for the sponsor, the amount earned for last years return will be the same as the anticipated income for the current year. BUT again, the anticipated gross income (with exceptions mentioned above).

 

You will get the notice that 125% is not met as the consequence of smth else not being correct, even when the income meets the requirement. There have been tons of these rfe's recently.

Was the rfe that they asked for 2016 return and then said it didn't meet 125%?
