My understanding for K1 and spousal visas your PD will always be current because there isn't a numerical cap on available visas whereas other family based visas have a set number and therefor it could be years (or decades) before a PD becomes current.

Anyone from the Houston center receive anything after the bio appointment. My NOA date was Dec 7 2016 and the bio apt was almost a month ago

 Being that your NOA is Nov 21st I'm assuming you filed early Nov and you are probably past the 90 days. You should submit a Service Request just to check on your case. Like many others have said there is no exact timeline so it could just be that the person who received your file may be slower than others lol but just to be sure send that SR

Finally got an update but it wasn't the kind I wanted to see. We just got an RFIE for the I-485 in the mail saying that my husband doesn't meet the financial requirements (he does) and that we listed assets on our I-864 (we didn't) but that no evidence was found. 

 

My husband doesn't file his taxes until just before the deadline because he's a freelance reporter and always has to pay in. We sent his last three tax returns, 6 months worth of pay stubs, and a copy of his contract from his employer. I'm thinking we need to resend the I-864, but what do we send with it this time? Bank statements? 

 

I feel like quite a few people have been getting this particular RFIE but I can't remember what impact it has on the processing of the EAD. I know it's different from getting an RFE but I'm not exactly sure how.

Send tax transcripts instead of photocopies of the returns.  Did you list assets on the I-864?  Does he meet the poverty guidelines?

They may have lost something I would just resend it, if they do not actually have the proof in their hand for whatever reason even if it is their error, they will send an RFIE for it. SMH. I mean that is one of the clearest evidences that they request and more likely than not most people understand that except of course when some ppl are self employed the instructions arent that clear. If they are asking for that and it was sent,  then more than likely they lost it...

I'm assuming it does, but does this stop the processing of the EAD until they get what they're looking for? If it didn't, I'd just wait until he does his taxes and send the newest return in too because it'll show that he made more than double what's required. Because it probably does, I have to try to figure out what else they might be looking for and what the handwritten "you listed assets but no evidence was found" means. We didn't say that we had assets (like property or savings) and they didn't say how much off of the required amount they think he is. Everything they highlighted on the letter covers things we've already sent. I suppose the easiest thing would be to get a co-sponsor but we definitely don't need one and there isn't a single person we could ask.

 

It's really frustrating when you know they're wrong about something and can't figure out how to immediately prove it to them beyond what you've already done. I'm honestly more concerned about the EAD than the I-485 right now because one means I could start working and contributing and the other is months and months off anyway. Ugh.

Their timeline shows mid november.  Processing times guide show they are working on 11/24/16.  OP should hear something soon.

It sounds like they may have made an error.  Like I stated before send tax transcripts instead of tax returns as this is confirmation from IRS that taxes were indeed filed.  Resend pay info you sent before along with a cover letter and with the I-864 showing that you did not indicate assets.

I'd have to double check, but I'm pretty sure that his 2015 tax return showed him just slightly under the amount they were looking for, which might be what's causing their confusion. The pay stubs we sent as evidence show that he's making well above what they need, so I'm hoping sending it all again will be enough. The 2016 tax return definitely would but, like I said in my first post, he doesn't submit his returns until almost at the deadline because he always ends up having to pay in around $3000. We won't have that to submit for another month or so, so I'm hoping the extra pay stubs from November until now plus bank statements will do it.
