Just thought I'd give an update.

Hi, we are in the same situation as you, except filed in October. We are also wondering what might happen, we haven't seen any movement on our case, and assume it is probably on hold, but I guess they are probably holding off on issuing EAD because they usually do a combo EAD/AP card, but not sure about how AP can work right now. Hopefully there are updates for it to be more clear. Fingers are crossed for you guys too.

P.S. We are currently in process of applying for Express Entry to Canada because we really do not feel confident that things will improve here especially for Iranians anytime soon, and my husband's F1 will expire after he defends his PhD within the next 6 months, so need a backup. If you are really interested in moving to Canada, we can give any insight we have so far on that process :)

Hello, I'm sorry you are also dealing with this tricky situation. If things go horribly wrong with the adjustment of status process we will be forced to look into it. It really is a troubling time.

Yeah, unfortunately these two announcements from the D.O.S. really pushed us over the edge.

It looks like they are not confident with things changing, even within 6 months. In the second announcement, it says "..the Department of State has temporarily stopped scheduling appointments and halted processing of immigrant visa applications for individuals who are nationals or dual nationals of Syria, Iraq, Iran, Libya, Somalia, Sudan, and Yemen." which means our applications are on hold for I would say 60 day minimum. Plus, they cancelled all February interviews for people from those 7 countries and said "If you received an interview appointment in February and have not yet attended the required medical exam, please cancel your medical examination appointment. Medical exam results are only valid for six (6) months and we cannot predict when your visa interview will be rescheduled." meaning they are not even sure this will be fixed in 6 months. So if we haven't even had an interview scheduled yet, it could easily be a year before anything changes.

 

Plus, now his family cannot visit us in the U.S. and if Iran does not comply with Trump's demands for information within 60 days (which realistically, is most likely not going to happen), the visa ban will be extended further. So for the sake of what things are looking like for the next 4 years, I would say Canada is a safe bet, especially if you want to be able to travel freely to and from Iran, and if your wife's family wants to come visit you. 

 

It is a really tricky time for sure, but we are here with you, and we wish you the best. I hope things change but I am not feeling good about it, especially seeing all of the support from the conservative side, and the fact that the Republicans have control of both the House and Senate (soon to have the tie breaking vote in the Judicial branch) and Trump's cabinet leading the various federal agencies..

Thanks for the posts. There are definitely unconfirmed reports of AOS adjudication for the listed countries being put on hold. I guess no one really knows. Canada may be a good bet especially considering how relations between the US and Iran are going. PM me if you have suggestions.

Hi all:

 

I'd like to confirm that the USCIS will be continuing to process applications from individuals from the countries affected. What I mean by that is, the earlier directive from Renaud has been walked back as of today. https://theintercept.com/2017/02/03/dhs-walks-back-immigration-directives-as-muslim-ban-chaos-continues/ Keep an ear out and watch carefully, but I think for now - those who may have been affected by the previous decision will be okay. It will still not help those who are outside of the US applying for visas at the moment, but it will certainly give those currently inside the US and adjusting status some peace of mind.

Thanks for the update. Filed on November 3rd, received on the 7th, and no updates so far. (88 days from when they received the case)

My interview has been scheduled! ?

 

"On February 02 2017, we scheduled you for your interview and mailed you an interview notice for Receipt Number MSCxxxxxx. Your interview is on March 10, 2017."

 

There is still no update for the EAD. I hadn't checked the status online for several days because there were no updates so I didn't want to keep worrying about it, but my husband just now checked the mail and walked in the room holding the letter. "Do I dare open it?" he said ?. I started to freak out because I thought it was an RFE so I quickly went to check the status online before opening the letter. Obviously I was surprised, but I'm very happy! Now if only I could get the EAD already! ?
