Please excuse my persistence, but I'm having a lot of trouble in getting the right information from everyone (officials) today...I was turned away from DMV last week as they said they wouldn't accept expired I-94, they wouldn't look at I-797 when in fact (according to the DMV website) they should have accepted these without hesitation.  The guy also told me I would have to wait for GC when in fact, I don't AND (more worryingly) he said I could continue to use my UK license (TOTALLY ILLEGAL)  Furthermore, the customer service center gave me MORE false information as did the District Manger!....Anyway, rant over, VJ has been the only consistent source of reliable information.  I just wish that the visa guides made it clearer that I would have problems once I-94 expired...I just assumed that I-797 from AOS and EAD would supercede the expired I-94 and it wouldn't matter.  

I mean the Social Security Office will not issue a new card during or after that time. I'm not familiar with Georgia's dmv requirements.. in Texas they don't require work authorized status.. just lawful presence according to the website... but I think most offices here still also require the ead.. and here they also require the SSC, but it doesn't have to be in your current name if you have marriage certificate.. so it varies...

Texas is the same but 90 days in stead of 30. One would wish they would say, 90 days or once you receive your EAD if you apply within those 90 days, whichever comes first. Then you would still only be able to drive temporarily, but you wouldn't be stuck in limbo if you did everything you were supposed to. There is no way to comply and avoid this situation.. that's what's dumb..

Even more funny... in another thread this guy said he was pulled over by Texas state police and they told him he was good to drive on his overseas license for 6 months... lol

I live in California, and even though I managed to get my SSN with my married name before the I-94 it didn't get me anywhere because for DL they also ask for a valid i-94 for at least 30 days. And they would only produce a license that would expire in the same date as I-94. So I need the EAD anyway.

One of my arguments why I should not be treated as a resident is that the bank has me down as a non-resident and won't let me change this to "resident" until I can provide a primary ID which the EAD is... sooOO according to them I am a non-resident...

Hi November filers,  just want to share that my K2's and I received all are combo card today in the mail. Now we are just waiting for an update on our GC application. Hopefully sooner

That's non-residency for tax purposes that the bank is concerned about.

Immigration-wise residency is defined differently,

And also the state residency criteria, each state has it's own.

 

So it's possible you're resident by some of those qualifications and not by the other. Traffic laws are concerned with state residency only, it doesn't matter what your federal immigration or taxation residency status is.

Hello everyone,

I'm new to this website. I have sent AOS documents since 2nd of November and they have recieved them since 7th of November. My biometric was done on 16th of December. I have been waiting for EAD since then.. I'm really tired of waiting  Is the application "case tracker" able to check EAD as well? Are those documents (EAD,AOS,AP) same case number? Its almost 90 days since they recieved it but nothing has updated yet.
