Be consistent with whatever story you tell.

Doesn't always work in OP's home country India. Applicants are prone to fudge the facts to improve their chances of an approval, as OP claims to have done 2 yrs ago.

I think it will be semantics. Since she was married, how can she be someone's girlfriend? My fiance was refused a B2 three times in two years for 'no ties' not making enough money in his home country. His home country does not approve of same sex relationships and infact downright violent about it. So he was correct in not disclosing that at his B2 interview. The refusals never came up in his K1 visa interview. Hope this helps

I was truthful about everything else, told the CO how we met, when she came, how long she stayed. The state she resides in requires a long separation time prior to applying for divorce, I guess I could have said all this, but my nerves got the best of me. I froze and then before I could come to my senses a "no" flew out of my mouth.

If we won't get questioned about it, we will let the sleeping dogs lie (pun intended), if we do, we will both stick to the truth from now on. :content:

Not sure if they will ask when relationship began....

I was it seems to be a routine question for k1 but for cr1 not sure since its a marriage vs engaged to marry.

The CO was typing away after I answered all his questions. He seemed to have zoned in on the topic and made some notes about it. I fear that these notes will pop up when our CR1 is handled. :blink:

Yes, it may be an issue. Will it be? No way to know right this second.

Material misrepresentation is a lifetime bar from the US for which there is a waiver available. I'm not sure it rises to that level even if the CO recorded it.

Frankly, that thought is so unbelievably horrifying for the both of us. :dead:

However unknowingly it may be, I have made my bed and now we have to wait and see if we will have to struggle through it. May the odds be ever in our favor!

I was told by the COs that it was the lack of ties (my age and the fact that I am in between jobs) and to re-apply when my situation changes.

If this is truly what happened, then I would say your other statements regarding whether or not she was your girlfriend would not be an issue. You may be asked about it, but I don't think it will matter much regarding a CR1 visa.

Yes, that is what I was told on both interviews. Seeing a bit of a light at the end of the tunnel now and lesson well learnt :thumbs:
