I apologize in advance if I am repeating questions that have already been answered on here.. I did search but it was not completely clear. Thank you in advance for all help!

1) In the state of Colorado my wife and I did self solemnization... which means we did not need an officiant or witnesses to obtain a legal marriage certificate. It is already done and recorded in the county recorders office. Should there be any issue with this for the submission of an I-485?

2) The marriage license and marriage certificate both list my wifes last name as her maiden name. For the I-485 in Part 1.. she wants to take my last name. Under Family name should I put her new last name? Or should I keep it as her maiden name which is what is on our marriage certificate? She does not have a SS# yet.. will we just have to get her name changed after the AoS is completed?

Go to SSN and get her SSN number. The marriage certificate will be her proof of name change. And yes even if it's in her old name it is proof that she can take your name.

All AOS documents should be written in her new name that way her new documents will come in her new name. If you use old name it will cost about $450 to get it changed after she got it.

on the form it states to write the name as it appears in the I-94 which is her old name and at that one you write her old name (as on I-94)

She could've obtained a SS# upon arrival to the USA. My then fiance obtain his 2 weeks after POE.

Use her new married name, the marriage certificate is proof of that name change.

Very good to know about the SSN. I see now that it only requires the I-94 and the visa on her passport. I guess the last question is the SSN needed for the I-485? Or can I just put the new last name on her I-485 without the SSN?

You don't need it for the I-485. Yes use her new name.

She might need SSN for other stuff. If her I-94 expires (actually with 2 weeks left on it) They will not give her SSN before she gets her EAD. So you have to find out if she'll need it for other things or she can wait.

Thank you again for all the clarification. I really dont want to make any mistakes. :)

One more if you all dont mind...

Under Section B of the I-485 - Should I enter my information as her spouse since we are now married?
