Bringing my mom who used to had a probation more than 20 years ago

Hi all,

My mom has just obtained the background check for herself. On the official paper, it is stated that she has been sentenced to 9 month probation in 1988 for speculation crime; however it is also stated that she is naturally abolished the sentence and considered as convicted according to current regulations. Now my question is, would it be possible for her to obtain the visa ? and what should I do to prepare for the interview ? My friend said that since she has been convicted in the past, it would be impossible for her to immigrant to the US....Can anyone please confirm that ? Thanks

It depends on the crime she did. What is a "speculation crime"?

Not impossible but difficult.

Was the crime involving gambling/financial trading?

On the translation court paper, it says speculation crime. What happened was that back in the 80s, it was against the law to buy/sale foreign tobacco in our country. My mom was caught doing that and she was placed on a probation by the district court.

Hard to say. Depends whether she bought an illegal pack of 20 smokes for her own personal consumption or whether she was orchestrating a smuggling operation and buying illegal foreign tobacco to sell on at a profit.
