Hey all,

Husband applied for removal in November 16, got an extension a couple months later because of back log from department. I’m pretty sure the extension has expired. Any suggestions on what to do? From what I can tell not many have been approved. Just trying to get an idea of how I can help him.

You need to get an InfoPass appointment here: https://my.uscis.gov/en/appointment/new?appointment[international]=false

They will give you an extension stamp at your local filed office. It's been discussed countless time, so it shouldn't be too difficult to find further info if needed. Hopefully he will get the ROC processed soon, but an extension is always a good thing to have, especially if you're planning for international travel.

Best of luck.

F-1 Visa: Academic years 2007/2010.

K-1 Visa: I-129F sent Aug 2013; Approved Jan 2014.

Green Card: AOS sent Feb 2014; Approved Jan 2015.

Removal of Conditions: I-751 sent Nov 2016; Approved Apr 2018.

US Citizenship: Application sent Nov 2017; Fingerprints Nov 2017; Civics/English exam March 2018; Oath May 2018.

They only suggest things.

Go to the interview, and you can tell the interviewer that after years of marriage, affidavits are embarrassing to ask for you, period. Assuming you’re having a hard time getting them. I got some for AOS, but its def what ill be saying this time around. After almost 4 years of marriage I will not be asking anyone for affidavits, I rather face a judge than explain to my relatives and friends whats going in families private life anymore.

You will not be denied for not having them and your wife being there.

Thank you for the advice. I completely agree with you. It's just ridiculous and embarrassing to ask for affidavits after years of marriage.

I have another question: Do you think it's a good idea to bring a lawyer with us to the interview? Since they have made it difficult from the beginning of this process, we are considering seeking professional help.

Thats def a personal choice, a lawyer can be a lot of help for someone who is not in tune with the procedures to atleast be broght up to speed with the basics, like dont answer more than youre asked, filing forms that can be confusing for none english speakers etc.

however if you read this forum on the regular and filed the papers yourself, a lawyer is pretty useless in straightforward cases, where lawyers are very important is once redflags are raised or denials happen, they are necessary for extra and complicated forms especially for cases headed to immigration court.

Its still very possible that you got called for an interview as part of the random small % that get interviewed.

In my opinion, if you are going with your spouse and with the the evidence you mentioned, save your money, as your interview will be routine and quick with certain approval, but no one knows your case better than you do.

So, I received some updates in my case and I am confused. The first one says "We are producing your card" and the newest says "We are reviewing your biometrics". I never got a status saying "you have been approved". So, where am I??

As you can see from my timeline below, the next update should be "we mailed your card to you ...".

April 3, 2018We mailed your card to you. The U.S. Postal Service will deliver it.
March 31, 2018We reviewed your biometrics and are still processing your case
March 29, 2018We are producing your card and will mail it to you
March 9, 2018We approved your case
March 8, 2018We corrected your name for your case
March 8, 2018We corrected your date of birth for your case
February 26, 2018We received your case
February 25, 2018We received your case
September 30, 2016We received your case

But I am missing the "We approved your case". I never got that! They corrected my name and date of birth too! I am wondering if they did approve it and the status is just now showing, or if the "we are producing your card" is a glitch and the case is still pending.

And if you are wondering where I got this status, I created an account here: https://myaccount.uscis.dhs.gov to file my N400 and I saw that you can actually also add paper applications, so I added my ROC. I actually follow my case also in https://egov.uscis.gov/casestatus/landing.do but they seem like two different databases somehow with similar but not the same info.

That's what I thought.

I did not have any affidavits in the original application.

However, I did have all the bank statements, mortgage payments, house title, tax returns, etc. All the financial pieces were included.

How should I complete the affidavits?

It's strange to see that you have already submitted the critical docs, so both you and your spouse are on the house title, and paying the mortgage right? It seems they attach big importance to a joint property deed, and also financial docs which you have submitted in the first place.

May I ask did you file the case thru attorney or you filed it on your own? The reason I ask is after Mid of 2016 cases, USCIS seems ask RFE on some cases prepared by attorney office.

Hi JimyAnita,

I saw they produced your green card 1 day after you attended your N 400 interview. So did you have a combo interview? Does the approval of I 751 have anything to do with N400? Thanks a lot in advance.

Well, my interview was on April the 3rd. They said it was a combo interview, however since "it was a special case, and they didn't have enough time", they will have to keep the case for review and if they needed something, they would let me know. Now the N400 shows as "We have approved" and "We will schedule your Oath", and the ROC one says "We will produce your card", however it doesn't say it had been approved. And in order to prove the N400, the ROC needs to be approved first. So I don't know if they messed something up or if I am in the right track. I also received mail a couple of days ago, saying that my ROC was at the National Benefits Center in order to process things faster.

I see, I think both of your cases got approved. Congratulations!

What did they mean " it's special case"? Is it anything unusual besides it has I 751 pending?

Really? Coincidentally, our ROC case was indeed prepared by an attorney.

But since I found this forum, I don't see the need of having an attorney anymore. However, since they have been giving us a hard time since the beginning of this whole process, we actually are considering seeking professional help - i.e. bringing a lawyer with us to the upcoming interview.

I honestly do not want a lawyer involved, just because it will get unfriendly real fast. But my spouse was suggesting us hiring one. I have been asking around for opinions, and am still debating.

Today I called and spoke with a Tier 2 Officer (as usual, quite a waste of time. because they don't seem to have any more information than the one posted online). And the "it's a special case" was because she was working with both my I751 and N400 at the same time. She explained to me something like "they give us only 45 minutes so I will need more time afterwards to review them".
