Hi All,

 

My NOA date is 11/23/2016 and I received my RFE yesterday in the mail. I'm very confused as to why I have got an RFE since I had submitted a very comprehensive package after consulting my lawyer (I filed it myself only took advice from him since he had filed for my green card when we got married in March 2014). 

 

Has anyone else got an RFE and then been approved? and if so then what additional documents did you send? Also how long did it take after the RFE was filed for the approval to come through?

 

Documents already submitted in the initial package - joint lease,joint tax returns,joint health insurance,Proof of travel together, affidavits from co-workers,Photographs of our recent memories. 

 

Additional items I can include foe RFE- State ID's with same address,Joint bank account, more recent tax returns,  latest health insurance.

Hi, your RFE letter suggests you what exactly they want to see. What does it say? 

 

About your “comprehensive” package, it missing key document like joint bank account statements with transaction details. This could easily trigger RFE as USICS pays a lot of attention to financial responsibilities shared. 

 

Do you have more than 1 lease and /or yearly extension? Submit all living accommodations throughout your marriage. 

State ID is a great piece of evidence 

do you own a car? 

Life insurance? 

Tax returns transcripts from IRS?

 

Most importantly, just read what they asking in RFE letter.

Lol now I feel stupid. You are right - they do pay a lot of attention to joint financial documents. We do not have a joint bank account but my husband will add my name to his account so we can send them a joint statement. 

 

We do have tax return transcripts from the IRS that we plan on submitting. No car (we live in manhattan) or life insurance. 

 

My mother in law and I jointly own the condo but the mortgage is in my husband's name so I guess that is some evidence too.

Well, your lawyer should have advised you to be added on joint account the day you had a consultation. Im not sure if that would make a significant difference to be added now and send just 1 statement because it’s obviously happened due to RFE, but probably won’t hurt neither. 

You need to write a good cover letter explaining what you have / don’t have. 

For example that you not planning / or planning later to have a kids, all your living situation since marriage with leases covering all these years, sending insurance cards with the same number and pages where you listed as each other’s beneficiary and indicating ongoing joint coverage, IRS transcripts (!) not just W2 or 1099 but an actual IRS transcripts and account summaries from the IRS (can order online or in person) for past years, and a good explanation why you guys don’t have a joint account and how you guys share financial matters in your family - who pays rent, groceries, where your salary’s deposited, etc etc. 

it’s ok not to have it, but you need to explain in your cover letter why so and how guys go about it. 

After you do that and USICS have a full picture, next thing you’ll see is  approval.

Thank you for that explanation it is very helpful. We have a lot of large financial transactions between my husband and I so we can include that in our packet. Appreciate your help.

Well, I probably underestimste  life insurance because honestly everyone can get it and cancel next day. While 2 years of joint savings and checking account is a pretty heavy financial commitment and even not all genuine couples have it in place and active. So to me, a significant amount on savings and active checking is much more of a proof rather than insurance that can be cancelled any second. Same goes to heath insurance. It’s a great pieces of evidences, but I would not put it in the first place.

You can cancel that is true, but the length of the contract and showing that you consistently pay for it and that it is in effect, shows a stronger commitment. At least that was what a lawyer friend told me.

Decided to check the status on https://egov.uscis.gov/casestatus and I was surprised to find this message:

New Card Is Being Produced

On May 18, 2018, we ordered your new card for Receipt Number

 

However, in my.uscis.gov, it says:

February 26, 2018

We received your case

You do not need to do anything at this time

I did not receive any email notifications. I'm not sure if I should trust this update.

Probably better to wait for the actual mail notification.

Congratulations! :) I’m confused though. If you November 2016 fillers and just got approved ( in May) that makes it 16 months, no?

I use this useful website for time/date calculations:

Result: 543 days

It is 543 days from the start date to the end date, but not including the end date

Or 1 year, 5 months, 27 days excluding the end date
