Guys please suggest

I applied for i130 in august.my husband is a green card holder.

My i130 has not been approved yet.

I want to ask when will I need my birth certificate.i mean at which stage?

I am asking this because my name is different in my birth certificate.my name is written like my nickname and then alias my real name.example: harry @realname.

Will that be a problem???please suggest

The beneficiary's BC is not required in filing the i130.

It will be needed later on during the NVC stage. What about the name on your passport? That's what matters because whatever name is in your passport the visa name will also reflect that and your GC will bear the same name.

Each and every document has my real name only.

It was just that at the time of my birth, my father had registered my nick name and then later on my real name was added with my nick name when I needed it.

So will they create a problem that every document has my real name and my birth certificate has both my name?

I am totally confused

If the name change is properly documented then you have nothing to worry about. Just show the proof of the name change.

Guys,Please suggest....and I need to submit the document at NVC stage right? Will i get RFE for not submitting birth certificate?

Yes, Birth Certificate is required at NVC Stage.

As far as name is concerned, you can always apply for name change in your local gazette office. They periodically publish a list of all the name changes applied within certain period of time (between two publish dates). You can change your name officially using this service. Make sure you mention that you also need the name change document in English language, otherwise they will only publish in local language.

I also had the same problem with name (i.e. Name A.K.A. Nickname) and I officially changed my name to exclude A.K.A. part from my BC. Please note that this does not apply any changes to your Original BC, it just aids you in officially using your desired name in place of what was registered on BC. Although we have not provided the gazette document with I-130, we plan to use this when needed at NVC stage.

I hope this helps. Good luck.

Thank you so much Tanish. :) May i know how much time the total process takes to change the name?

I would not be able to give you the timeline, as I did this process over 10 years ago and I do not recall. You might be able to get the ETA from your local municipal office. They have a separate section for handling name change applications.
