Conditional GC interview soon

Hi everyone,

I submitted my AOS package mid August and received notification today that my interview is December 7th. (I came to the US on a K-1 visa in June and married July 16th). I have a couple of concerns regarding the 'evidence of a bonfide relationship' aspect of the interview.

Firstly, what we do have is plenty of proof of relationship in terms of travel together, her coming to South Africa to meet my family, photo's of our lives together, the wedding, honeymoon etc.......

My concern lies in what we don't have. I have not yet received my EAD card so I obviously have not started working yet. We have a joint bank account we use for everyday purchases and living. The lease, gas and electricity bill is in both our names and I am on my spouse's car insurance policy. I am also a beneficiary on her work IRA. Because I am not working we have not yet taken out life insurance policies together, nor is the car loan in both our names. We don't have too much spare cash since we're on a single income at the moment. We also haven't (obviously) filed taxes together as that only happens in March.

Will the extent of our evidence be sufficient? I know come the 2nd interview (nearer to our second anniversary) we will have much more, but for now, we don't have that much? Come December 7th we will have been married 4.5 months only, and like I said, I wouldn't have started work as yet.......

Any advice or insight will really be appreciated. Thank you!

This forum won't be the best for you to get answers, you're way past the k1. Please take the time to read the adjustment of status forum, there will be lots of threads discussing interviews and documents.

I was concerned just like you but everything was alright in the end.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

What you have seems to be enough for AOS. They tend to understand you are newly married and do not have a lot of joint documentation yet. Just take what financial co-mingling and co-habitation evidence you do have.

You won't be needing an EAD once the green card is approved, so you may never receive it. And yes, you will need a lot more evidence for ROC later, but most likely will not have an interview at that time. Most ROC applications are approve without interview.

I can't think of much more documentary evidence you could have at this point.

After a year of living here (and few months after getting my green card) we went to get a new car and lease it in both our names. They rejected me as I had no credit rating (I had no credit card in the US, and we own our house outright so no mortgage) so we ended up with the lease just in my wife's name again. This is after I've been here a year! So I don't think the fact that you aren't on the car lease should raise any eyebrows. I'd be amazed if you get any problems.

I've since chatted to my (very helpful) bank manager and sorted out a credit card... I'll try to do most of my expenditure on it each month and then pay it off. Bank manager says I should have a credit rating after 6 months or so.
