Hi everyone,

Topics says it all.

Could you guys give us some sorts of checklist or guideline so that I might got some clue where I could start with the AOS application based on B1/B2 visas?(if you have cover letter, thats perfect too)

My cousin came by tourist visa early this year then she found her love and they married last month.

She has overstayed few months, will it raise any red flag for her aos then?

I just sent my AOS last week based on K1 visa so I know quite a bit for I-485 but her case needs to file I-485 along with I-130 which Im not really confident at.

Please help!

You should be able to access the guides tabs. Go to Guides -- Adjusting from other types of visas

You may have to adapt the available cover letters to fit the situation. Just change the wording so it makes sense with your particular AOS.

There are some other threads on this that may help also. Your cousin should become a member of VJ and do some research on her own to be more effective.

She will have to be active herself on visajourney then.

One more thing, coz she has overstayed and married after her status expired. So someone said she needs to pay the punishment fee. Is this correct? Whether she has married usc she is still put under penalty?

Her overstay will be forgiven now since she is married to a US Citizen

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

Hi,

My husband is also a B-2 Overstay. There is no penalty for B-2 because they did not come with the intent to marry like a K-1 Person.

Once she gets married her fiancé can file for her.

Im no expert, but just by research I have learned she needs to complete the following forms:

I-130 Petition for alien relative $420

I-485 Adjustment of status $985

I-864 Affidavit of support $0

I-765 Employment authorization $380 (or free if filed with I-485)

I-693 Report of Medical Examination and Vaccination Record $0

G-325A Biographic information (for your cousin and her spouse) $0

Biometrics $85 (paid later)

Again, I'm new myself and looking for guidance...hope this helps :-)

I also sent my aos fr k1 on 29 and today they cashed the check.

Hope I could get text or email next week. Coz I filed with g1145.

I'm not sure but usually it's about 10pm and 11:30pm. But I understand that if you don't receive it in seven days after your check cashed you could call USCIS to get the receipt number until you receive the hardcopy NOA.

I realized after I posted this when I did a search on the USCIS website that Biometrics had to be paid the same time....although I thought I read somewhere else it could be paid separate.

Thanks for the clarification. Will definitely put the Bio fee and 485 fee in the same money order.
