You have to send it back but call them first to let them know before sending because it might take like 6 months to get another one....I am also adjusting from K1 National benefit center......I am a June filer.When I where did u file please

hi

it happens quite often, you have to send it back with the i90 for them to correct it

The above is correct with one important addition, since it's a USCIS error, no fee will be required.

Our journey:

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Can you explain why it is an error to receive a 10-year green card? I wouldn't think so, if I hadn't seen this forum post.

Your permanent residence status is conditional if it is based on a marriage that was less than 2 years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or adjustment of your status to permanent residence.

Your attorney is outright dumb and wrong.

You can believe him/her and do nothing. Your choice.

Here is the office USCIS website about 2 year conditional green card:

https://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage

You are married in february 2016 and sent in AOS april 2016.

Obviously you are not married for more than 2 years.

Listening to that attorney will net you nothing but serious consequences, it would probably be best to sever ties with that attorney as quickly as possible.

You need to send the card back to USCIS with an I-90, since it's a USCIS error, you will pay no fee to receive the correct card.

also what address i will be sending . i think the nearest uscis local field office here in our place is jacksonville.

sad to say my husband not cooperating he keep in tell that its right green card and he believe to our attorney.

looking forward to hear all your advice . thank you ....

Here is my sample cover letter:

To whom it may concern:

I am requesting to replace the I-551 Alien Registration Card due to USCIS administrative error on my I-551 card as follows:

The incorrect card states expiration date with 10 year validity.

The correct expiration date should be 2 year validity.

Reason:

My permanent residence status is conditional based on marriage under K1 status which is less than 2 years at the time the Form I-485 is approved.

Enclosed, please find the following:

1. Completed I-90 Application to Replace Permanent Resident Card

2. Original I-551 Alien Registration Card with error

3. Evidence of USCIS error:

- Copy of I-485 Approval Letter

- Copy of K1 visa and I-94

- Copy of Marriage Certificate

Please process and acknowledge receipt at your earliest convenience.

Thank you.
