Call them and have the operator process the DS-261 over the phone. That will trigger the AOS fee to be unlocked. If not you will have to wait several weeks until they review it.

Hi JFH/jrigual,

Called them just Now, they r saying since NVC didn't send any welcome letter they can't review DS 261.

Should I wait for the welcome letter or call NVC again?

I called NVC this morning to check if my docs were received and scanned yet. It was emailed early morning Nov 4th. Ukraine consulate is one of those that allows electronic processing. Anyway, the agent tells me my consulate does not do electronic processing. So I was getting upset and arguing with her. I called back and spoke to another agent who confirmed electronic processing for CR-1/IR-1 is accepted there. They cannot tell me the email was received as it hasn't been logged in yet. So I still have no scan date. It's been a frustrating morning.

They can do it. Just the agent you talked to didn't want to. I would call again.

We're still waiting on that to unlock as well. They sure were quick to take the money out of our account! Would be nice if they were as quick to unlock the form.

1)Unemployed

2)No

3)You need a joint sponsor

4)Correct.

Passport pics are not needed for NVC.

3. Even if he lived and worked overseas, as a USC he is bound by law to file taxes unless his income was below the federal minimum. He may not have to pay any taxes, but he still has to file. if he was below the minimum then he must send a signed statement saying that his income was too low to file. For the purposes of immigration, he will need to find a joint sponsor for you, unless he has significant assets (cash savings, more than one property, etc).

thank you MrsBurgz and JFH!! very very helpful

so for part 6

1. put unemployed

2. "annual income", "current income", "annual household" put "0" ? cos he work aboard and just got back to US last month

3. for the evidence, I need to attach info about the tax my men filed to US government while he was aboard?

4. where can I find the info about minimum income? does the statement have template?

5. my mother in law can be our joint sponsor, so means she need to fill in I-864, right?

thank you for people's help, really appreciate!!

1) He need to fill out his own I-864 as well as you. So you will send in two I-864 with your civil docs.

2) Just write a letter explaining the reason you didn't work/file taxes in 2015.
