I-134 or I-1864?

Someone please perhaps clear this basic point up for me because USCIS could not do it for me.

My wife will be getting a non-immigrant K-3.

Affidavit of support is required naturally, and my mother will be acting as a Joint Sponsor. The embassy asks for the I-134 form.

There was some confusion about sponsorship and the like because the I-134 doesn't have a co-sponsor/joint sponsor equivalent as the I-864 with the I-864a. My mother said send both as a cover. I doubt that is necessary - am I correct? We both send an I-134, and the I-864 will filled later for the AOS process, yes?

So, since my wife is applying for a non-immigrant visa, we just send the I-134 and do the I-864 later. If she was applying for an immigrant CR-1 visa, then we'd be sending the I-864 now (instead of an I-134). Yes?

Regards,

J.

jassan,

That's right - when sponsoring a non-immigrant there is only a sponsor, who, if it's requested (and it usually is), submits an I-134 as part of their financial documentation.

I-864A is not for a Joint Sponsor. A Joint Sponsor submits an I-864, same as the Sponsor.

..... the I-134 doesn't have a co-sponsor/joint sponsor equivalent as the I-864 with the I-864a. .....

Regards,

J.

From NVC FAQ on the DOS site

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Thanks to the both of you. I posted in a hurry as my time was limited and I couldn't research the forum in depth. Later I saw this question was covered.

Regarding the question - I figured as much and tried to check my understanding with USCIS, but they informed me they weren't trained in the forms and there was no one I could be transferred to confirm my assumption.
