Ok so my fiance worked in Macau for over a year. When her contract was up and it was time for her to go, she went to the police and fingerprinted and requested a police clearance.

She immediately left right after.

Her friend that is still in Macau collected the police clearancr for her when it was ready a week later and sent it to her in the Philippines. It was dated the day AFTER she has stamped on her exit stamp. This is good so there is NO OVERLAP of dates.

This part is what bothers me:

Term of Validity

The Criminal Record Certificate is valid for 90 days from the date of issue

So what does that mean? Even tho she has NOT set foot back in Macau - do we really need a new one?

I submitted this police clearance front loading my k1 that we filed last week... So technically I submitted it within its window of validity. Will they honor it? Or will it expire in waiting for the interview when it will be asked for?

My police certificate was also only valid for 3 months, it was already past the validity when I had my interview, but it was not an issue.

The PCC is usually valid for a year even though it states otherwise on the certificate that was issued by the country, if she comes back again in Macau then she will need a new one.

I think it depends who is the interviewer. My fiancee had a police clearance from Japan and it was 4 years old and they accepted it. The interviewer asked if my fiancee has been to Japan the last 4 years and she said no, so the interviewer accepted it. So hopefully you will have the same interviewer.

Main thing is the police clearances and NBI need to be submitted during the interview phase for the K1, not with the I-129F.

So at that point it will have to be a valid certificate to take to the embassy.

You will need to get a new one when the interview comes up.

Note: The interviewer at the embassy may accept an 'expired' police certificate from another country, or they may make you get it and resubmit it and cause a delay in AP. Better just be safe and plan on getting a new one.

I think it depends who is the interviewer. My fiancee had a police clearance from Japan and it was 4 years old and they accepted it. The interviewer asked if my fiancee has been to Japan the last 4 years and she said no, so the interviewer accepted it. So hopefully you will have the same interviewer.

The interviewer followed the correct rules for the certificate...

Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued.

So if the certificate was issued after you left the country, and you haven't returned since, then its still valid, whatever the expiry printed on it. Makes perfect sense when you think about it... if you had no criminal record on that date, and haven't returned back since, then you can't have committed any offences there in the meantime.
