My wife and I wanted to travel to Canada for the holidays visit family. We are currently in the AOS of status phase awaiting approval or interview. she has been approved for EAD / AP. We verified numerously with USCIS if we would have any trouble flying to Canada or anywhere else out of the country should we decide to and the answer was of course " No Problem" , as long she is approved for AP.

So now, I've recently came across The ETA or (Electronic Travel Authorization) on the Canadian airline website. here's a copy of the rule >>>

The Government of Canada has introduced a new entry requirement, known as an Electronic Travel Authorization (eTA), that applies to visa-exempt foreign nationals* travelling to or transiting Canada by air.

Effective March 15, 2016, visa-exempt foreign nationals are expected to have an eTA before they can board a flight to Canada. Until September 29, 2016, travellers who do not have an eTA can board their flight, as long as they have appropriate travel documents, such as a valid passport. , you will need your passport, a credit card and an email address. An eTA costs $7 CAD and is valid for up to five years.

Has anyone been affected by this new rule and can we still travel to Canada with an Advance parole while awaiting AOS approval..??

As long as she does not have her GC yet, she'll need a visa to visit Canada as a Haitian citizen. The AP is only good for re-entry to the US.

If it isn't difficult, it isn't worth it.

You might actually want to spend the $7 to find out if she really needs a visa. It's likely she does but she's also in a bit of a gray area where AOS is filed but not approved.

I'm curious what the ETA form looks like.

Eta is for people who would normally need a visa to visit Canada and are flying. It used to be that if you had a green card you no longer needed a visa to visit Canada but they've changed the rules a bit, at least for flights.

Doesn't even need to spend the money. The website clearly tells you if you'll need a visa or ETA: http://www.cic.gc.ca/english/visit/visas.asp. As long as she doesn't have a green card, she'll need a visa.

Eta is for people who would normally need a visa to visit Canada and are flying. It used to be that if you had a green card you no longer needed a visa to visit Canada but they've changed the rules a bit, at least for flights.

I think you have a typo - you mean that people who previously DIDN'T need a visa, now need an ETA to arrive in Canada by air.

If it isn't difficult, it isn't worth it.

It is accurate, the website clearly tells Wether you need and ETA or Visa. And we're finishing up the on line application will submit by Friday this week.

Big question now " how long is that process?" We booked a flight for november 29th.

No. People who would have otherwise needed a visa to visit Canada who are lpr now need the eta. Previously they did not because lpr of the usa did not need a visa to travel to canada regardless of country.

Ah, I guess you were just not being clear. The facts:

People who previously did not need a visa to Canada (Scandinavians for instance), now need an ETA for arrival by air.

People who previously needed a visa, still need a visa.

All US LPR's need an ETA for arrival by air.

USC's do not need an ETA.

If it isn't difficult, it isn't worth it.
