Hi all. I am in need of some help. My wife was recently granted a visa to join me here in the US, but my step-son's citizenship is under question. If I'm not mistaken, I believe I was told that his father must have a letter notarized stating that he holds no claims to his son's citizenship as an American. Once the embassy in Santo Domingo has this letter, we are free to acquire my step-son's visa as a foreigner. Has anyone else been through this experience? Is this all that is needed to complete the process? If so, does anyone have access to a sample letter I can use to send to the boy's father? Any help would be greatly appreciated as I am trying to get my family here in time for the upcoming holidays. Thank you so much!

I'm not sure what you mean by the father not having claim to his sons American citizenship? The boy will not be getting USC anytime soon.

All that is needed is consent for the child to move to the US.

Normally it's something like

I (name) give permission to (mother name) to move with (child's name) permanently to the USA.

The problem we are having is the embassy questioning whether my step-son, who was born out of wedlock, is actually an American citizen because his father is. From what I understand, if his father claims him as a US citizen he can get a US passport and travel here. But, the father is not being entirely cooperative because of the legal forms that need to be filed with the embassy. I was told the alternativce, because we had already applied for his visa, was to have the father deny his claim to American citizenship. Then, we can proceed with the visa process as normal. The father is giving me a slight hard time and wants me to draft the letter for him, so I was looking for the most acurate way to state our desires. Thanks for the input.

If dad is on birth certificate he needs to sign permission to leave DR.

Dads prob worried about USA child support orders probably being selfish.

Ah see that makes more sense. You weren't really clear about the dad being a USC.

I agree with Anita he doesn't want to claim the kid as he will owe child support and most likely back support.
