I have no idea what i just read........ but a small part of me is panicking.... btw i have ADHD its sooo hard for me to get all these acronyms... and forms.... income this... spouse that... assets... form h329d3iie3...then fill out form292973jso. what you just typed.... Thats exactly what my brain heard. I cant wait for this to be over in.... some years how ever long this process takes....:unsure::blink::ranting:

A Washington State Federal judge in Seattle just agreed to a nationwide temporary halt to the immigration ban, holy #######!

"The order will remain in place until U.S. District Court Senior Judge James L. Robart considers a lawsuit challenging key provisions of the president’s order as illegal and unconstitutional. If the lawsuit prevails, President Trump's executive order would be permanently invalidated nationwide.

Robart was nominated to the court by President George W. Bush in 2003.

Robart ruled against government lawyers' claims that the states of Washington and Minnesota did not have the standing to challenge Trump's order and said they showed their case was likely to succeed.

"The state has met its burden in demonstrating immediate and irreparable injury," Robart said.

He said the ruling means Trump's executive order cannot be carried out and that people in the seven affected countries can now come to the United States.

"This decision shuts down the executive order immediately."

Let me try to clarify....

 

1) The first point refers to the income of the intending immigrant. Generally, for somebody filing AOS from a K-1 visa, beneficiary has no incoming income to qualifies (because they are not allowed to work in the US yet). Note this refers to income, not assets.

2) Yes, the assets may be used. Asset-based qualification is generally not used because it requires at least 3x the level of income required (125% of the federal poverty level). It can only include assets which can be liquid within 1 year (i.e. no retirement plans or long-term bonds at full value).

 

So yes, there are circumstances where the assets of the intending immigrant can be used. It's just generally not the case.

They should be pretty accurate. The numbers are coming straight from USCIS. Unless they are doing some magic in their reporting.
