Does it take longer for them to process petition if the petitioner/beneficiary is divorced or have child? My fiancé is divorced and we both have kids. Mine is 6 and his is 5. I wonder how long the waiting period for approval is... Anyone with similar case who recently got approved?

I don't think that it will cause a delay as long as you are both legally separated/divorced/annulled and you have sent the documents proving this. I have read on this on some forums and blogs and it was never a cause. I called uscis earlier and they said that the only cause of delay will be RFEs. Hope this helps.

Hm, for people who have never married before, how could they prove that they can marry? There is no such certificate, is there?

In the Philippines, we file certificate of no marriage (CENOMAR).

That is cool. How about the US citizen if he has never married before? Is there a certificate of no marriage in the US?

I assume the certificate of no marriage (CENOMAR) is only availlable for the fiancee in the Philippines...

My fiancé said he didn't know it existed so I guess there is no such thing as CENOMAR in the US. :)

No such thing but we are talking about the all powerful US Federal Government who has nearly every data base at their disposal.

Prior years tax filings of married filing joint or married filing separate would be a 1st start.

They can access county and state websites for marital indicators such as property tax assessment, liens and even loan documents.

There is however no certificate or document here in USA which sole purpose is to prove no marriage.
