I have zero desire or plan to have a pre-nuptial but that is a personal decision that people need to make.

Ok don't know if prenup would be required if you have no assets to start.  I guess if you won lottery after married or earn money together after then that would not be part of pre-nup.

Oh I don't want to think about divorce I don't even have my NOA 2 yet...lol

Could your I-134 affidavit of support form be used against a pre-nup?  I can vision a scenario where a very good divorce lawyer would say that a petitioner stated in their i-134 affidavit of support that they will support the beneficiary, thus, making the pre-nup void. 

 

Everyone has their own opinion, but, I can't fault anyone for wanting to get a pre-nup.  Divorce is UGLY!

The I-134 isn't legally binding, so I don't think that would come into play. I think you meant the I-864? Even that only comes into play with regard to supporting the beneficiary instead of becoming a public charge. So I guess if the pre-nup tried to offer less than that, the I-864 (and any I-864a apps with it) would still come into play. That said, any pre-nup that tried to offer less than that would likely not hold any water in the first place.

"Because INA 212(a)(4)(C) and INA 213A require the use of Form I-864 for so many classes of immigrants, the use of Form I-134, has been reduced considerably.  Nevertheless, there still are circumstances when Form I-134 will be beneficial.  This affidavit, submitted by the applicant at your request, is not legally binding on the sponsor and should not be accorded the same weight as Form I-864.  Form I-134 should be given consideration as one form of evidence, however, in conjunction with the other forms of evidence mentioned below."

Interesting information.  Prenups are a hot button topic amongst couples that are engaged.  I generally hear two schools of thought:

 

"If you want a prenup, you are already planning on failing - so why bother getting married?"

vs.

"Getting a prenup is like buying car insurance.  I don't plan on using it, but happier to have it if needed"

 

I can see one also wanting to protect assets for children that are already born or if one spouse has a sizable estate vs. the other.  I have a good friend that's a family law attorney.  His biggest recommendation to couples before getting married is to make sure both you and your finance's finances are under control.  He said money issues and not having a clear expectation on finances is the main underlaying factor in the divorces that he sees in his practice.  

Work hard, save, but spend wisely!

In terms of assets my understanding is what is brought into the marriage remains yours as separate assets - nonmarital property. So as far as kids is concerned I believe they are already protected even in divorce as this is your "nonmarital property". Where it gets sticky is when you use the property to buy marital property. So a prenup is more just to make sure there is no misunderstanding as you have said.

I have held off with posting my searches on the app up until now, but I figured since I have an Excel sheet where I track it anyway, why not share the day-to-day results. Now, I haven't gone the extra mile of tracking exactly where one date starts and another date stops; using trial and error though, I started tracking K1-petitions starting at WAC1790044500 and ending at WAC1790052899 (received between Oct 28 and Nov 2). 

Out of all these numbers, there are 836 K1-petitions, out of which 53 were rejected after about 2 days due to reasons such as failing to sign or sending an incorrect fee. As of Monday (Jan 23) night, there are 273 approvals, 131 RFEs, and 379 unworked cases (category is called other, and as far as I know cases that are withdrawn and a few other things go into the same category). 

While 379 may sound like a horrendous figure for only 3 days, compared to 2 weeks ago (9 business days; Jan 9), they really did make a move; on Jan 9, there were 544 unworked cases. While the amount of petitions worked on each day may seem small, at least they're touching them again - as Jim and others stated already, they didn't really do anything for almost a month a couple of weeks ago. 

 

Anyway, I hope you guys have a great day - and yet again: to more approvals this week!!

I'm using the iPhone case tracker app, and my figures come from there. VJ only is just a small part and, IMHO, not all that representative anyway... I do this each day, and I'll try to remember to post it here every day as well.
