Wow, that sounds incredibly cheap. There are a lot of acronyms and phrases that are foreign to me in the guide, but I'll have to look it up! I kind of figured the visa bringing him here would cost us over 1000 dollars. No, he lives in AUS right now and our daughter and myself live here in the USA. We are not married, actually divorced but wanting to work things out and live here. I figure because of the divorce we are going to have problems.....

Ah I see now. The process really is whether or not your fiance eligible for the visa, and are you eligible to sponsor him (as a USC, non criminal, free to marry, etc).

I've not yet seen the USCIS make a decision based on morals - at least not in the context of who you were married to before and why. The only way that fact effects you is for you to document that you are, indeed, divorced and therefore eligible for a fiance visa.

The VERY FIRST place you need to go is to www.uscis.gov - that's the official website for US Citizenship and Immigration Services - the agency you'll be dealing with for the first part of the process. Explore it. Learn it. Love it.

One useful stop - the "Immigration Forms" button in the top bar of the page. Click on it. Scroll down to "I-129f - Petition for Alien Fiance(e)." Click on that. Read the information that pops up. Then click on the link to the form.

Then - and this is the really, really, super important part: READ ALL OF THE INSTRUCTIONS. Then read them again. Then read the form itself. Then read the instructions and the form again altogether. Then re-read them again, having printed them out, with a highlighter in hand. Then come back here, read the K1 guide and the FAQ page. THEN start navigating through the forums to see what common questions pop up here over and over again.

But you ABSOLUTELY MUST familiarize yourself with the USCIS homepage because THERE is where you confirm the hard facts like filing fees and addresses. VJ is an excellent, comprehensive source of information. A lot of it is reliable. But for the basic, nuts-and-bolts, it is solely your responsibility to educate yourself and know where to find the basics. And it is solely your responsibility to double check the filing fee and that you have the most recent edition of any form - yourself!

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

What is a non tourist visa? As to him visiting, he can fly here anytime he wants...once you file though, he has to show ties to his country at the POE. If the CBP thinks he's going to fly here with the intent to immigrate, he might get denied and sent back. It has happened before. He'll need to show strong ties with the intention of returning to wait out the visa process. Things like mortgage, utility bills, etc. Return tickets aren't proof.

What do you mean by "non-tourist visa?" Does he have another sort that grants him entry? He's Aussie? Does he have VWP privileges?

There's a lot of information and threads here about visiting during the process. It is both no problem AND a big headache. There's things he'll need to do to prepare. But flesh out your question a bit and we'll be able to better answer you.
