I-751 package likely to be received 1 day early than actual filing date?

Hey CookieCat,

I'm little worried so wanted to ask you for suggestion. I sent my package today (10/28/2016) and since I used the Flat rate 2-Day service ( I was trying to delay the delivery since the earliest USCIS can receive my application is 11/1/2016 since my GC expires on 1/30/2017 but I had already put in a box and it was hard for unwrap and send it via ground which takes 6 days). So looks like USCIS will receive on Monday. USPS lady told me there is 50/50 for Monday/Tuesday but still I'm little worried what if USCIS receives on 10/31/2016 (Monday) and return my package?

Since you have been a VJ member for a while, have you heard of anyone getting their package back for 1 day early? I tried to search on VJ forums but did not see 1 day early filing issue. I saw some people getting their package return for 4-5 days or more?

Hey Everyone,

I'm in a dilemma after I sent my application to USCIS today via USPS. I was thinking to use regular 5-6 business days shipping but since I had already put my applications in Lg flat rate box, USPS told me that it might get delivered on Monday(10/31/2016). Since I had already used USPS box, It was hard for me to take it out again and ship in regular box. The earliest accepted date for my application is 11/01/2016 based on my card expiry date (1/30/2017).

Do anyone have experience with this? I hope the package gets delivered late Monday like on evening so they will open on Tuesday and I will be on time.

It was fault on my end but too late to act now.

Any suggestions?

Why didn't u mail it tomorrow? If it is received early, they will send the entire package back to you.

Yes nothing I can do. It says expected delivery Monday October 31st. I'm hoping they will open the package on Tuesday and it's a signature delivery.

One more question, let's say USCIS gets my package on Monday and opens it. is it possible they accept the package now and deny me later after 6 months due to filing before 90 days or so?

No. They do preliminary checks upon receiving the package such as checking you filed within the window, for signatures, missing pages, whether the check is there and in the right amount. They won't wait 6 months then decide you were outside the window. If they are going to send it back they will probably get it back to you within the month.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Yes, I've seen members receiving their package back for sending it one day early and I've also seen some members getting away with it. So you'll just have to wait and see. Good luck on your I-751.

Hi CookieCat, So I got my package returned back today, so I will have to send it again. But one question, I see they send me my original check back and they have a stamp at the back. Do I need to send completely new check?

Is the I-751 fee debited from your account associated with this check? If it's been debited, then send the same check back to them when your mail your package again. If USCIS did not debit your I-751 fee (which is how it should be), then send a new check and void this check that was returned to you.

(Day 88) 04/23/16: In line for oath scheduling *Called USCIS to inquire about why there is an oath required for a child under 14. They sent a service request to the field office.

(Day 95) 04/30/16: Received letter from field office to say no oath necessary and that they would mail the certificate.
(Day 106) 05/11/16: Cert of Citizenship received by registered mail (they never sent tracking. case status was never updated either)

oh wow really, I got mine within 4 days after the package got delivered to USCIS CSC and good thing they did not cash my check. I will resubmit it on Monday and I was able to add 3 more documents too.

I can imagine that happens because the first wave of staff who inspect the I-751 form and the filing fee didn't notice or thought it would be ok to accept the package a day early, then when it got to an actual adjudicator months later, they had other ideas!

yes I think USCIS has been much more careful and systematic on these matter these days. They even removed my 2 inch Acco fastners (Since I had used like 6 of them) and they put just in 2 8-inch Acco fastners.

Anyway I resend my package yesterday. Hopefully no more issues lol.

i am in the same predicament. USPS told me it would be delivered on 2/13, but instead it was delivered today,2/11 :angry:. I am so stressed that it will be rejected and mailed back! Do you think that since it was received in Saturday, that I may be safe and it's actually approved since Monday is when the 90 days start?

When I sent my I-130 just over 2 years ago, they picked it up on a Sunday and marked the received date as such. That was at a lockbox though, not a service center. I think you will need to wait and see. How far off are you from your expiration date?
