The income they count is before deductions? I thought other wise. Interested in what others say, does this include deductions and expenses?

Gross income, before taxes.

If you are an employee, then you list your current annual income, not what you made last year on your taxes, and provide letter from employer and/or recent pay stubs to show that amount.

If you are self-employed, then it will be your Total Income, line 22 of the 1040. This is gross income, but after business expenses are deducted.

Okay so I i've worked about almost a year, and i filed taxes like jan of last year, so I had very little since I only worked a couple months in my last job. About March of this year, I got a promotion at work, to where I now made more than the 125% poverty level, I used to not make the poverty level. I get paid by a varied commission (it varies) and can be unpridictable. Ive only been earning commission income for about 7 months, during that 7 months I have made about $20,000.00 so my boss says to take my total its like $25,555.00 divide it by 7, then multiply it x12 which is about 44,139, about 300.00 off my bosses 44,400 estimate but he says $929.00 per week estimated average. So I figure that basically means I'd be about $40,000.00 gross total income for a year based on my performance. But to not use the exact number, as I wouldn't get that every year. So I low balled to $40,000.00 per year. This is what I thought might want to see. Because my tax return for 2015 won't show it, its only gonna show $5,000.00 and that's when I was on Salary and not making commission. My paystubs and my bosses statement and the employer's statement would show that I have earned $25,550, and if you add another 5 or so more months it'll be about $40,000 Can anyone advise me on my complicated situation and if I made the correct decisions?

PolarBearCBB, you are going to have to go with your employer's letter and pay stubs that confirm the letter. If they are consistent, you should be OK. So the employer letter should say something like you have a full time job salary (base) plus commission (average) of about $40,000 per year. Submit that and your two most recent paystubs confirming that. Maybe provide more paystubs. In this case, the tax return is too much information because it does not say what you want.

Help, I am trying to figure out what to put for Annual Income on I - 134

My Tax Return last year barely shows but $3,000.00 or so earned since I only worked just 4 months.

Paystub says YTD ($) $25,753.81

Income Type: Variable Commission

I started working on 10/13/2015 (YTD about $4,000)

Got a promotion on April 3rd 2016 (Earned about $21,000 over 7 months)

My employer say that my average gross earnings was approximately $927 a week. (that he feels this is a solid reference point to use in forcasting my future income) included eight weeks compensation reports as well. (I also have 4 months worth of pay stubs too) So thats what I got from him, he wouldn't put amount per year and informed me that I should low ball the total as I won't make the same amount year to year. It could be $30K one year or 40K the next year.

So what do I write on that line?

A. $40,000 - $45,000 ?

B. $35,000 - $45,000

C. $25,753.81

D. $44,496.00

E. $44149.38 ($25,753.81 divided by 7 (months of commission) 3679.00 x 12)

Gross income, before taxes.

$927 a week times 52 weeks = $48,204 annually. You can use what the employer gave you as your estimated weekly earnings plus recent pay stubs, and you are well above the income requirements, even if you want to 'low-ball it'. https://www.uscis.gov/system/files_force/files/form/i-864p.pdf
