Hi Everyone :) !

I live in NYC with my Husband. I arrived on the K1 at the end of September and my (then) Fiancee and I got married two weeks later in mid October. Now we are gathering the documents to Adjust my Status and I have the following question: I changed my last name during the marriage ceremony and would like to know if I can file for AOS with my old passport (which features my maiden name) or do I need to apply for a new passport at the German Embassy in NYC?

You don't need a passport to apply for AOS.

If you changed name to your husbands name then you use that when you fill out your papers.

It's okay your old documents ID and stuff are in your old name, your marriage certificate if your proof of name change.

Hmm... thanks for your swift response but I'm pretty sure I need to hand in a copy of my passport. Like I said, I just wanted to know if my new last name needs to be featured in the passport or if my maiden-name is fine. Thanks!

Yes you do. But your also give a copy of your marriage certificate when you file and that is proof of name change.

IF you file in old name then your GC will come in old name and it is expensive to get that changed. Like $400or something if I'm not wrong can't remember the exact amount.

All my ID is in my old name but I took my husbands name when we got married and all my AOS is in my new name.
