Hi All,

My wife, a Filipina, had her AOS approved a few months back. Her children (16 and 19) just arrived in the US. One will be a student in the 9th grade and another will be looking for employment as he is a college graduate. We are applying for SS Cards now for both. My question is primarily for the 19 year old:

Q. He wants to look for work as soon as possible. Since his mom, the K1 visa, has been given a temporary green card (AOS approved), should he file for the AOS only, or should he submit the EAD first?

Hope that all makes sense.

Thanks,

Charlie

hi

the EAD is included in the adjustment of status packet, so it will be a few months for him to be able to look for work and get a job

the sooner you file adjustment of status for him, the sooner he will get his EAD,

for now he can volunteer in some place he is interested in so he gets a feel of things

The I-765 (EAD) is free to file when filing the I-485 (AOS), usually EAD is issued a 2-4 months after filing ... and as slow as VSC has been that may be a good idea.

(EAD is not included in any package with the K-1 so that other comment isn't valid)

There is a difference between K1 and K2 in obtaining their social security numbers - a K1 can get it right after arrival, within a validity of K1's I-94. But K2 is illegible for a social security # without EAD or actual a green card.

Hate to say that, but first - you should submit K2's AOS/EAD/AP paperwork. The "walk" to the Social Security Office now will be useless and waste of time..
