My son has been in Spain for the last two years and recently got engaged to a girl from Venezuela . She has been living in Spain for the last year but does not have legal residency in Spain. It is not safe for her to go back to Venezuela because of the conditions in that country right now. What I have read is, if you don't have special problems then you really don't need a lawyer to get a Fiance visa. However we are worried that her being illegal in Spain will cause problems with getting her visa. Does anyone have any experience with this kind of a situation. Is this something that would mean we really should pay for a lawyer.

Can she get her Police Certificate and other documents remotely?

A lawyer can't really help with them allowing a interview and medical location where she is not legally resident.

If she feels so unsafe in Venezuela that she cannot even stay in a hotel for a couple of weeks there, requesting asylum in Spain may be an option.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
