Fiance had another K1 filed for her 6 months ago. Problem? (split and merge)

Hi,

What I can tell you is that everyone else on here has made perfect sense in giving you advice. Your relationship will be scrutinized deeply because that is what immigration officials do. It sounds like your gf is probably trying to gain immigration benefits but people should not be treated like clothing in a store - try it on, buy it and then decide they no longer like it. Marriage is a very serious thing; coupled with attempts to gain a US immigrant visa, then that is a gateway for govt officials to pry into your personal lives.

No one can say what your outcome will be if you apply for a fiance visa but you must show solid relationship proof....saying to the IO that you love her and she loves you just won't cut it. Do you know why your gf situation did not work out before? Are you sure she didn't get married to the other guy? Save yourself the headache and try to get some indepth background on this woman before you commit yourself to immigration scam hell.

I have all the evidence of relationship with her, I know she does not want any papers on emigration, because she asked me to live in the country of her, but I can not live in the country of her, plus she is very honest me, I know not how to determine whether the former case it is expired how can I find out, I'll try the process of k1 for her I want to marry her I love her and she loves me, if we can not k1 then I I will marry her in the country of her, my girlfriend does not care about papers

No one on here is disputing that you love your gf.

Anyways, the only true way to know about her previous K1 is to ask her. You are saying that she does not want papers for immigration...but have you heard of the term "reverse psychology" lately? :goofy:

Again, no one here can know the real intention but you must be vigilant in what you are seeking to do. Precautionary measures pay off in the long run. I mean, why would you file for a fiance visa if she is not willing to come to the US to be with you? It is more expensive than a spouse visa because you pay for the K1 visa, then you pay to file the Adjustment papers; then there's the personal finances for the actual wedding which must take place within 90 days of entering the US.

A spouse visa is cheaper but then, it begs to question, why would you marry someone to live countries apart? West Africa is on the other end of the globe!

I know after all the advice given, you will still do as you please and that is okay. Just don't say you weren't made aware of all the possibilities of things turning sour.

my case is the same exactly as your gf . i was approved a k1 in November last year,however after i entered the united states ,i found out that my american fiancee was cheating on me ,So we didnt get married,and i came back home later on before my visa expire.

now im in a relationship with a different american girl ,and im debating myself whether to go the k1 route again ,which is alot shorter in time ( coz who wants to be distant from their other half ) ,or get married and go for CR1 which takes almost twice the k1 time .

each one has its pros and cons...so hopefully some one here who had similar experience,or knows some one who did, would put on more light regarding this.

it's not an easy choice.

Did you ask her why didn't it work out for her previously with previous partner?

Marriage is not something to treat so lightly.

For embassy officers and for officers at CBP it will look like attempt at marriage fraud from both of you and you might face legal consequences also.

So if you're completely 100% committed to each other you need to pursue CR1 path.

If you're citizen as you claim then you also need to be aware of possible affidavit of support abuse and there were tons of threads where people crying about marriage fraud because they didn't know each other well enough.

You do realize that it sounds like she is very desperate to come here for the Green Card and she may say she loves you but her actions says she loves a Green Card and she'll most likely ditch you once she's here? That is how the Consulate will look at it.

Love is not easily turned on & off, bur compromises can be made for

GC by some (not saying its absolutely your case) Thread slowly

sure.. USCIS only approves the I-129F petition

It is the US Consulate that will do the grilling or roasting of the immigrant during K1 visa interview :whistle:
