You are not making any sense. First you say she had a K1 visa and then you say she may have a problem IF he applied for a visa for her.

Hmm, sounds like you can try and go ahead with it but there may be a possibility that it could be denied due to the short time span between the last K-1. Also, when a K-1 is denied, you basically don't have any other option except to marry and go for a CR-1 spouse visa. K-1's aren't reviewed if they are denied.

Also, did she actually marry this previous person did the first K-1 with? You'll need to know info about her previous relationship as it will most likely come up in the interview.

As the other members have mentioned, yes, it looks like it is most likely going to cause suspicion.

It doesn't matter that she was only one month in the USA, it might look like she is "shopping around" for someone to bring her to the US and maybe she just didn't like the guy so went back and found another USC who she liked more. I'm not saying she's doing that, but that's what might go through the minds of the CO's when they review your case. Hence, it can be problematic and there's more of a risk.

Don't take it personally, but CO's are trained to be skeptical of all applicants. If the applicant has more red flags, the higher the chance of scrutiny or a possible denial.

It is not an automatic denial, and it is good she left the USA and did not overstay when no marriage occured but it is a big red flag to have another relationship with another USC and get petitioned so quickly. For a better success rate, give it some more time, and visit at least once more before petitioning her.

You are fine, it's not you they are going to be skeptical about, it's her. I agree with Penguin, let more time pass and visit her at least once more....it'll mean your chances will be higher, that's all. If you're planning to spend the rest of your life with this person, it can't hurt to let more time go by and see them face-to-face a few more times before diving into the visa process.
