Hi My name is Danny I am USC Petitioner living abroad with my fiancee soon to marry and flie for a CR-1 VISA. Before moving to be with her i was aware that i could file the petition at the local embassy but i was very wrong and turns out i cant direct file also they do not have any local offices in the country either. i have been living here for 1 year as of dec, i am not working i am basically here to stay with my love until we can get the visa..

So my concern is that i was told i must and must go back to the USA and stay there and file the petition and cannot do it from here, is this true? my fiancee is going crazy over the thought of me leaving already so i must try to find another solution to file from here. has anyone filed a petition from abroad if so how and where. how does one pay the fee or what address do i include in the petition? my current address here or one in usa? [PLEASE HELP IF YOU CAN IM VERY BUMMED AND NEED A SOULUTION..

I imagine airfare might be a little tight if you're not working but maybe you could come back to the US and file the papers and fly back and be with her while you wait? You would probably have to show residence even if its with a family member and you'd most likely need a co-sponsor (are they allowed with marriage visas?) considering you don't have income and havn't for almost a year. I hope another member can offer a better solution because I really don't know if it can be done abroad. Best Wishes.

You can file from abroad but must fulfill the terms of the I-864 including domicile. Read the instructions and figure out what you need to do to fulfill them.

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
