My maternal uncle in usa since 40 years and still they are.

They applied visa for my mother and also for us in november 2004 and its expiry date augest 2018.Meanwhile my mother died in october 2016.

My question is that is this file countinue for us or not??

is there option to solve this issue ??? because me and my dad want to go usa.i am unmarried 25 years old.my dad is 60 years old.

Please i need answer of my question

your uncle cannot apply for you nor your dad, the only one that could have was your mother but she passed away, sorry but you have no chance to move to the US .

Humanitarian reinstatement is a discretionary form of relief available to the principal beneficiary of an approved Form I-130, Petition for Alien Relative, that was approved prior to the death of the petitioner.

Your case is the primary Benficiary died, not the USC petitioner.

Hi,

Sorry on the loss of your mother.

Your mother's death ends the case. There is no path for you or your father to continue the case. The petitioner needs to inform the NVC to end processing the case. (Without informing the NVC of your mother's death, the NVC will continue the case unaware that she has passed. Don't waste money paying the fees.)

Humanitarian reinstatement is not available when the principal beneficiary dies. Humanitarian parole would only work if you or your father are physically in the US right now.

What happens to the derivative beneficiary's case if the principal beneficiary dies?

If the principal beneficiary dies at any time before the derivative beneficiary immigrates to the United States, the consular officer will not be able to issue a visa to the derivative beneficiary. Humanitarian reinstatement does not apply in such a case, though humanitarian parole may be an option. Please see 9 FAM 42.1 N4 (PDF, 149 Kb) for more information on humanitarian parole.

It is all moot now but you may well have aged out.
