I have read on VJ (so not 100% reliable) that if you enter the USA and activate the visa after 2 yrs of marriage (like u plan on doing) you should get the IR-1 visa (10 yr greencard) Thus if that is true, would be very worthwhile to delay ur coming to the USA. Best of luck!! I do recal another in a similar situation where they did enter after 2 yrs, but only got the cr-1, but they made an infopass appt, and I belive got it switched to the IR-1, but I could be mistaken!!

A topic that I checked in the other forum (CR-1/IR-1) had two differing responses . . . one said if your interview is 2 years after marriage and the other said if you enter 2 years after marriage. I think it is time to get a definitive answer from someone not on VJ, LOL!!! It would certainly be nice not to have to file to lift conditions 2 years after you enter the States.

It doesn't matter when you enter the US---it's if you have been married for 2 years or more when you adjust status you get the 10 year GC. UNLESS you had a problem during the inital interview and were denied [hard denial- not reg 221g] then your 2 year time frame starts after reapproval.

This I got from an Immigration atty....so I'm hoping he's right. He also says that when Atif and I FINALLY get to have our interview Atif should get the 10 year card. I don't care-----I just want the blasted interview!!
