Another request from the uscis

I hope each and everyone having enough strength to stand for the frustration and the stress of this journey,

May God help us all and also those who already pass through, massive congratulations to all of you,

So I am waiting for a decision on my case which I don't know how long it will take, so then I applied for advanced payroll, then they reject it, I called and had level 2 officer on the phone, and he told me they making decision on my case so there is no need to apply for advanced payrole, then I just received mail today that asking me to go for another medical s exams because the uscis changed their law June 1 2016,

So I know I can visit a surgeon here in the USA but my question is! After this medical exams or after they receive it, then I need to wait for another 9months again before they will be making decision or they will be making decision when they receive the result?

And the mail said go back to the surgeon again, I had my medical s in Amsterdam Netherlands and I don't have advance payroll how can back

Is anyone else experiencing this or is only me

When was your first medical exam? Was it within the past year?

Did you send in the DS3025?

Yes it was last year and the uscis received it 10/09/2015 and their policies is 1 year so that means it still have like 2 to 3 weeks more before it expires

Was your DS3025 marked complete or are you missing vaccinations ?

You have to read exactly what they are requesting, you really only need a CS transcription if your DS3025 was not marked

complete/waiver requested. Did you submit it and keep a copy for yourself so you can check it ?

If the RFE says you do need to submit a new medical then you need to get it done, perhaps the IO doesn't understand K1

entries don't need a new medical if you filed AOS within one year of it.

Usually after submitting it it won't take long to get approval.

I don't understand your advance parole (you keep saying payroll) issue and the reason it was denied so I can't help you further.

Yes I did submitted everything it was in the sealed envelope and yes we did marked or tipped every box we supposed to

So my plan is tomorrow at my first break at school I will call to have a level 2 officer to have a more deep enquirers

You don't mark the box on the DS3025. The medical facility does and then gives the form to you to send in for AOS. Did you send the DS3025 with your other AOS documents??

Yes my wife filled all the necessary forms, we supposed to fill and I added the sealed envelope from the surgeon attached to it, my wife purposely called the uscis to aske which forms we supposed to filled and they told us everything and also what to do, and that's what makes me wonder sometimes because they keep requesting for this and that, everyday new thing, and when I call them also they always tell me everything is perfect so if only I can provide what has been requested, then we good to go, but then after they will end up asking for another thing, which I don't get it

The DS2035 is marked by the panel physician in your country. You do NOT mark anything on it.

What is the date of your medical in your country ?

As the link states, if you submitted the medical within one year to AOS then you don't need a new medical.

If you do need it then you go to a Civil Surgeon on the USCIS list and get the vaccs transcribed to a I-693.

K1's are not required to do a new medical, though many Civil Surgeons will insist on it and some

immigration officers are wrong in requesting it.

If you did receive a RFE for a new medical and or vaccinations then you can either get it done and submit it or

argue with them why you do not need one and show them their own regulations. (In the link I provided).

What I bolded....what form are you talking about ? So you did already see a civil surgeon or what ?

RFE's can come at any time during AOS, even after an interview.

Calling the USCIS is not always helpfull because many that answer the phone have no idea what they are talking about.

Even speaking to a tier 2 does not always bring results.

Make an infopass if you are still not clear on what to submit and request to speak to a real immigration officer there, not just

anyone. Take all your RFE;s with you.

Following each RFE directly will render you the fastest way to be approved.

I had my medicals in 4/25/2015 and I enter us 10/23/2015

And got married 10/30/2015 and afterwards submitted everything and they did received my application 11/9/2015 so then I don't know neither understand why I do need a new medicals

Some send out RFE's for a new medical if the AOS is not adjudicated in one year of doing the medical, which is of course not

correct.

If you can, post a copy of your RFE's here so we can see them and maybe you misunderstand something it contains

or it is general information from a template and you do not need it. Can't say without seeing the RFE (s).

Black out any personal information (name, case number etc).

I know you posted some of what it says but I would have to see it all.
